The eighteenth National Congress and the Third Plenary Session of the eighteenth Central Committee of the CPC announced a strategic plan to deepen the reform on a large scale and put forward the reform of the market supervision system in an integrative way.The market supervision has opened new pathways for the optimization and integration of the market supervision system.Recently,many provinces and cities in China have been exploring ways to reform market supervision and administration system.Large-scale system and comprehensive law enforcement are the main trends of these reforms.As the pioneer of China's reform,Pudong New Area's market supervision and administration system reform is also at the forefront of the country.This paper intends to examine the policy implementation of the Pudong market supervision and administration system reform based on Smith model.The current policy implementation is analyzed through the four dimensions: idealized policies,implementing agencies,target groups and environmental factors.The objective of this paper is to sort out the various factors affecting policy implementation;find out the weaknesses in the policy implementation process;and then put forward recommendations for future improvement.The conclusions and recommendations from this study will provide useful resources for future policy decision-making regarding national and provincial-level market supervision and administration system reform.This study identifies major obstacles in current policy implementation and the underlying mechanism in terms of the following four dimensions as discussed in the Smith model:At the ideal policy level:(1)the enforcement of trademark supervision from the Pudong market supervision department is not satisfactory;(2)the market supervision function has an overly centralized tendency;(3)because “market supervision” is a broad term so that the function of the market supervision department is not clear;and(4)there is no direct one-to-one correspondence between the offices at the city and district levels.The major explanations for these problems is due to the “bottom-up approach” in the policy implementation process.As such,there is in consistency of market supervision system at different administrative level because at that time the reform did not start at supervisory departments at the city and national level upper level.At the executive level:(1)increased pressure on staffs in the supervisory department due to high workload and required duties and(2)difficulty in taking care of both professional supervision and comprehensive supervision.The major reasons can be attributed to:(1)excessive number of units to be supervised in the Pudong region while lacking sufficient manpower;(2)differences in market supervision systems at the city and district level causes mismatch in the supervision practice;(3)differences in professional areas requires different knowledge and expertise to perform supervision functions;(4)the regulatory concepts have not been updated to meet the new practice and reality,and(5)the regulatory approach and methods need to be revised and updated.At the target group level:(1)the increase in the number of target groups being supervised brings new challenges to market supervision;(2)the lack of cooperate responsibility and week self-discipline role performed by industrywide associations and organizations;(3)public awareness of the functions of market supervision need to be increased for consumers,different organizations and administrative units;(4)the efficiency of response to customer questions and demand for information should be enhanced;and(5)the law enforcement force in practice has been abused.The major explanation can be attributed to the following reasons:(1)the regulatory concept and supervision method need to be optimized;(2)the supervision enforcement must be enhanced and cooperate responsibility of the involved parties should be clarified;(3)the public awareness of the Pudong market supervision system reform policy should be increase;(4)all personals of the market supervision should improve their work related professional knowledge in each specialty field,and(5)the boundary of duty performed by market supervision should be delineated.At the level of environmental factors:(1)new market supervision programs is emerging along with the economic development;(2)changing in social value and increasing legal knowledge has raised expectations and standard for market supervision departments;(3)the new technology development has improved the level of quality inspecting techniques as well as fraudulent skills;(4)while encouraging the supervision role performed by mass media and public opinion,such media role should not be abused;(5)there is insufficient of publics involvement and participation in market supervision.The major conclusion based on above analyses include:(1)continuously optimize the reform of the market supervision system when facing new and emerging problems;(2)develop innovative approach to cope with higher market supervision demand and requirement as well as more sophisticated fraudulent techniques;and(3)there is a growing need to encourage and guide the media and public and social interest groups to participate in market supervision and to build a social co-governance mechanism.In response to these problems and emerging challenges,the proposed countermeasures can be summarized as following recommendations:(1)strengthening the top-level design and adopt a “top-down” reform path;(2)delineating the boundaries of duties for market supervision and increasing public knowledge and awareness of the functions of market supervision;(3)adopting the regulation philosophy of scientification,delicacy and intelligentization to adapt to the urbanization process;(4)optimizing internal and external coordination systems and establishing a high efficient operation mechanism;(5)developing high quality workforce in market supervision by adopting effective measures;(6)revising and updating regulatory philosophies and methods by exploring innovative ways market supervision approaches,and(7)promoting social co-governance and building an integrated "four-in-one" market supervision system.
