Property Rights Of Farmers' Homesteads In The Background Of Three Rights Separation Research On Implementation Mechanism

To reform the management system of rural homestead and let the rural homestead circulate in a certain range to realize its real right value is the focus of our country's rural work.Years of rural practice tells us that the reform of three rights of homestead is an important way to increase the property income of farmers.Explore the market allocation of homestead to provide farmers with more channels to release property value,give full play to the property properties of homestead,is conducive to solving the problem of the dual development of urban and rural areas.At home and abroad were reviewed in this paper about the land circulation and earnings on the basis of the theory of institutional change theory grounded theory as the instruction,in order to land in our country as the research object through the mechanism analysis,qualitative analysis,interview method and case method to our country "three division" under the background of peasant household land property rights and implementation issues for further discussion.In my opinion,the main problems of realizing the homestead property rights and interests of farmers include: low efficiency of homestead transfer,insufficient comprehensive capacity of homestead main body,and lack of income mechanism of homestead transfer.This paper aims to answer the following questions: first,explore the relationship between "three rights separation" and the transfer of homestead in China;Second,explore the transfer of homestead and homestead transfer income relationship;Third,explore the factors affecting the transfer of homestead;Fourth,explore the realization of homestead property rights of farmers under different models.For the above research,draw a conclusion from this: first,the income of homestead in China is mainly realized through the transfer of homestead.The influencing factors of homestead property rights and interests of farmers can be regarded as the influencing factors of homestead transfer,which determines the degree of realization of homestead property rights and interests.Only by keeping clear of the obstacles of homestead transfer can the property rights and interests of farmers' homestead be better realized.Second,"three rights split" can effectively improve the transfer income of homestead.By clarifying property right,the efficiency of homestead transfer can be promoted,so as to realize homestead property rights and interests.Thirdly,the income of homestead transfer has the problem of low income and unbalanced income distribution."Separation of three rights" is conducive to the development of the right to use live homestead,promote efficient transfer of homestead,explore a variety of transfer mode of homestead,can increase the transfer income of rural homestead,determine the main position of rural homestead property rights,can solve the problem of uneven distribution of homestead property rights.Based on the above conclusions,combined with the reform requirements of "three rights and three rights",this paper proposes reform Suggestions on the property right mechanism of rural homestead,three-right".In practice,we should speed up the legislation of homestead and constantly push forward the confirmation of homestead right.Second,foster market transfer mechanism of homestead.In practice,the market information platform of homestead should be built,intermediary organizations should be cultivated,and the price evaluation mechanism of homestead should be established.Third,build a service-oriented government.In practice,we should cultivate the rural financial market,improve the homestead mortgage mechanism,We will establish a rural security system.Fourth,the farmers as the main body of the construction of income distribution mechanism homestead.In practice,we should strengthen publicity and education,and open up channels for farmers to safeguard their rights.This article combines theory and practice to study this problem,but it still has some shortcomings.There are mainly the following aspects.First,the case study is mainly in the eastern region,which is not fully covered.The area studied in this paper is an area with a high economic degree.The homestead reform in this area is at the leading level in the country,and the transfer income of homestead is relatively high.However,for some central and western regions and remote rural areas,whether these theories are also suitable needs further study.Second,the research of quantitative analysis may need to be strengthened.In this paper,the method of grounded theory is used for qualitative research,but the detailed quantitative analysis involves too little.In the future,the specific benefits to the property rights and interests of farmers' homestead will be the focus of the research.
