In the tide of the rapid development of urban integration in China,China's ordinary agricultural areas are undergoing earth-shaking changes.Rural rural labor force into the city,the rural economy has been rapid development,farmers housing conditions have been greatly improved,most farmers can build a new house,there are some farmers have the ability to purchase commercial housing.In this way,there will be many vacant homesteads,but the current "one house",restricting the circulation of rural homestead circulation system,not only makes the farmers' property rights are not guaranteed,and more than the vacant chaos also Resulting in a great waste of agricultural land resources.This system of imperfections caused a series of chaos,homestead use right gray deal,transfer contract is not standardized,the right to use the right to use the rural homestead is difficult to be protected,anti-urbanization needs can not be met.This article is based on the field investigation of the current situation of the right of use of the residential land in the city of Lion Mountain Village in Macheng City,Hubei Province.Through the anatomical "sparrow" approach,the author finds that the village exists in the process of the transfer of the right to use the homestead Problems and contradictions,and to find out the causes of these problems behind the deep level of institutional reasons,and then for these shortcomings to improve the common rural area homestead transfer system feasibility proposals.The questionnaire is mainly for the farmers to build their own homes to obtain the base of the way,idle homestead situation,is willing to sell homestead use rights,the transfer of homestead objects and homestead occupancy compensation and other issues to investigate.Through the investigation I found that the city of Lions Hill Village homestead idle problem countless,resulting in homestead idle reasons are mainly the following aspects:homestead exit the lack of incentive mechanism;homestead exit compensation pricing mechanism is imperfect,so produce a lot Social disputes;homestead distribution scope is limited,the right buyers can not participate in the fair;the current "one house" system,in essence,further spawned homestead more vacant phenomenon.I hope that through the improvement of the right to use the right to use homestead system,to achieve a win-win goal:on the one hand to protect the legitimate rights and interests of farmers without loss of farmers' social security system more perfect;on the other hand in the protection of homestead resources on the basis of Can play the homestead of the capital attributes,the sleeping homestead resources into mobile capital,to leveraging the greater capital into the rural market to promote the process of building a new socialist countryside.Based on this,this article to improve the right to use the right to transfer homestead are in the protection of farmers' core rights and interests,to ensure fair trade,the efficiency of the conduct and strict control of land use principles put forward.I suggest:to clear the property rights of the homestead boundary,let go rural rural homestead circulation range,waste "one home" for "one person a room",the establishment of homestead circulation platform,but also improve the rural social security system.
