An Investigation And Analysis Of Withdrawal Of Rural Collective Operating Assets Equity Rights With Compensation Based On The Practice In Sichuan

The Third Plenary Session of the Eighteenth Central Committee of the Communist Party of China decided to carry out comprehensive and deepening reform,and proposed that “the system and mechanism of integration of urban and rural development should be improved,more property rights should be given to the farmers,protect the rights of members of farmers' collective economic organizations,and give the famers the right to withdraw the equity rights of rural collective operating assets with compensation.” after that,these propositions can often be seen on the documents about agricultural and rural area and the farmers promulgated and implemented by the Central Committee of the Communist Party of China and the State Council.Under the guidance of policy,academia has paid great attention to this proposition,and related research has increased sharply.Including the guidelines of the central policy,the enlightenment of other scholars and some problems in practice,are the main reasons to choose this topic.On the basis of defining clearly the connotation of rural collective operating assets(excluding land)and other related concepts,this study is to help to set up a more suitable theoretical framework of withdrawal of the equity rights of rural collective operating assets with compensation based on practice in Sichuan,promoting the improvement of local system construction.Moreover,this paper also aiming to provide a reference path for the revitalization of rural collective assets by the study of withdrawal of the equity rights of rural collective operating assets with compensation and equity transfer,and then promotes the preservation and appreciation of rural collective assets,to safeguard farmers' shareholders' rights and increase their income.The framework of this paper is as follows.The first chapter is an introduction,which mainly elaborates the background and significance of the topic and gives a summary of the domestic and foreign research.The second chapter mainly clarifying the concepts involved in this paper,and combing the relevant theories.Chapter ? is the feasibility analysis of the withdrawal of rural collective operating assets equity with compensation,on the one hand,it makes a theoretical analysis of the feasibility with the help of relevant theories,on the other hand,it discusses the realistic basis of the feasibility combining with the conditions of realistic elements.Chapter ? is a summary of the research,which mainly studies exploratory measures,case enlightenment and realistic predicament of the practice of withdrawal of the equity rights of rural collective operating assets with compensation in parts areas in Sichuan.Chapter ? is the system design,after making a comparative study of the system regulations issued by other regions in China,draws lessons from them and finds out the shortcomings,this paper puts forward the idea of system improvement based on the feasibility of withdrawal of the equity rights of rural collective operating assets with compensation.The sixth chapter is the conclusions and recommendations,it mainly summarizes the viewpoints and innovations of the paper,and puts forward suggestions for policy improvement based on the practical difficulties of Chapter ? and the related contents of Chapter ?.
