China is in a period of transition.The reform of the economic system is continuously deepening,the pace of urbanization is accelerating,social disharmony,insecurity,and uncertain factors are increasing.The social security situation is becoming increasingly severe,and the maintenance of public security order is becoming more difficult.Public security organs play an irreplaceable role in maintaining the stability of social order and cracking down on crimes However,China has implemented a strict establishment system and the number of police officers is limited.In such a situation,the stretched police resources are difficult to meet the requirements of realistic stability maintenance.In order to effectively solve the problem of social security,various social forces must be mobilized and various methods used to prevent and control public security.The emergence of the auxiliary police is the value pursuit of safety and order by human beings,a concrete practice of implementing the mass line of public security organs,and an inevitable choice for achieving optimal social governance.The participation of auxiliary police in public security governance is undoubtedly the most effective way to solve the plight of public security police affairs.The participation of auxiliary police has effectively alleviated the problem of insufficient police resources and saved administrative costs while improving the efficiency of police work.However,compared with countries such as Anglo-American law,China has not yet formed a complete auxiliary police system,and the formulation of relevant laws and regulations and the construction of auxiliary police teams lack standardized and professional guidance.Due to the lack of clear legal regulations,whether the auxiliary police can conduct law and order administration and whether they can assist the police to participate in law enforcement has raised doubts in the theoretical and practical circlesAuxiliary police play an active role in maintaining social order,alleviating the shortage of police resources and improving the efficiency of police work.In recent years,with the increase in the number of auxiliary police and the continuous growth of the team,the auxiliary police have become a significant party in maintaining social order.However,due to the lack of perfect legal and institutional guarantees in China,there are irregularities in the participation of auxiliary police in law enforcement,which seriously affects the development and construction of auxiliary police teams.The irregularities in the participation of the auxiliary police in law enforcement are mainly manifested in the unclear legal status,irregular terms of reference,flaws in the procedures for participating in law enforcement,and incomplete liability and supervision mechanisms.As a new mode of social governance,auxiliary police participation in law enforcement has unavoidable new contradictions and problems in practice.In the face of these exposed defects,we can’t just blindly magnify it to question the necessity of the auxiliary police,nor can we ignore the need to make the development of the auxiliary police into trouble,but we must analyze the problem and pay attention to it while paying attention to it.This article analyzes the problems existing in the participation of auxiliary police in law enforcement,and uses the theory of administrative commission and administrative assistants in combination with China ’s legislative practice to scientifically establish the legal status of auxiliary police as administrative assistants in public security organs.At the same time,under the guidance of the principles of legal retention and administrative efficiency Based on the terms of reference of the Police,legally define the terms of reference of the Auxiliary Police and make feasible suggestions on the procedures and responsibilities and supervision of the Auxiliary Police ’s participation in law enforcement in order to standardize the Auxiliary Police ’s participation in law enforcement. |
