In the process of China’s judicial reform,shortage of police force and many other problems are increasingly acute;as a result,academic circle and legal profession gradually turns their attention to the role and legal status of auxiliary police officers,which have triggered wide discussion.Firstly,due to the lack of well-established institutional systems and existence of many internal and external constraints,auxiliary police officers often behave irregularly in law enforcement so that their roles may fail to bring into play.Secondly,imperfection of China’s laws concerning auxiliary police leads to exposure of numerous weaknesses and deficiencies,and thus credibility of public security force and harmonious relationship between the police and the citizens are affected.This thesis clarifies the intention and extension of many a conceptions including auxiliary police officers and their legal status,by means of literature analysis,case analysis and other research methods,combining theory of administrative assistance,theory of administrative entrustment and other relevant theories of administrative law with legal practice of auxiliary police officers.Furthermore,taking reference of development of systems of auxiliary police in other countries and districts,this study mainly discusses multitudinous weaknesses in China’s system and corresponding solutions under the current judicial reform so as to explore the necessity of establishing administrative entrustment mode of China’s system of auxiliary police,specific suggestions and measures as well.Meanwhile,pursuant to suggestions issued by General Office of the State Council of the People’s Republic of China,this thesis canvasses the actual impact of such Suggestions after the authoritative interpretation on legal status of China’s auxiliary police officers.This thesis consists of six chapters.Chapter One is an introduction which sorts out questions about the legal status of auxiliary police officers and other aspects,and this chapter elucidates and analyzes conception definition and theoretical basis.The Chapter Two elaborates development of system of auxiliary police in China,learns from it and explores those worth keeping and absorbing.The third part focuses on development of legal status of auxiliary police officers in auxiliary police system in other countries and districts,and then attempts to gain practical methods and systems conforming to China’s actual conditions.Chapter Four mainly discusses the legal status of current auxiliary police system and its deficiencies.The fifth part aims to study the legal status of auxiliary police officers and suggests that unite administrative entrustment and administrative assistance,and appropriately empower auxiliary police officers,primarily as administrative assistants,by ways of administrative entrustment and others.Finally,Chapter Six concludes the author’s perspectives on the issues of the legal status of auxiliary police officers.
