For a long time,the regional allocation of police resources in China’s public security organs is unbalanced.Under the circumstances that the central government strictly controls public security,the practice of social security governance with the help of the service of auxiliary police has become popular.The historical predecessor of the service auxiliary police can be traced back to the period of public security joint defense.The participation of the service auxiliary police in law enforcement should be defined as the administrative assistance behavior in the administrative assistance theory.While the law enforcement of the Auxiliary Police has achieved results,there are also many problems:the legal system for regulating the service of the auxiliary police is not perfect,which is embodied in the unified legal system that does not form the law enforcement of the auxiliary police,and the boundary of the law enforcement power of the service assistant is blurred.The law enforcement procedures of the police are not standardized;the administrative support for the law enforcement of the auxiliary police officers is not perfect,which is reflected in the lack of the training and assessment mechanism for the law enforcement and access control of the auxiliary police,the unreasonable allocation of auxiliary police resources,and the unsound pension protection mechanism for the service and auxiliary police;The lack of police law enforcement responsibility and supervision mechanism is embodied in the lack of effective accountability and supervision mechanism for the illegal law enforcement of the service auxiliary police.This paper uses the internal control theory and contract management theory of the law enforcement and auxiliary police enforcement,and proposes to transform the traditional concept of safeguarding the service of the auxiliary police to the legal system of the law enforcement and the law enforcement of the auxiliary police.To ensure and improve the "three-in-one",regulatory mechanism for the responsibility and supervision mechanism of the auxiliary police.The regulation mechanism emphasizes the blindness and low-quality expansion of the Auxiliary Police,and avoids the financial burden caused by the long-term employment of the Auxiliary Police and the excessive income growth.It is necessary to introduce the evaluation and exit mechanism reasonably and achieve a steady rectification.It is suggested that the legislative authorities should limit the authority of the public security organs to employ the auxiliary police to assist in law enforcement,clarify the boundaries of the service and auxiliary police,improve the procedures for the enforcement of the auxiliary police,and improve the access training and assessment mechanism for the service of the auxiliary police,and optimize the auxiliary police resources.To configure and establish the rights guarantee and restraint mechanism for the service auxiliary police;to clarify the legal responsibilities of the public security organs,the service assistant police,and the class police for the illegal auxiliary activities,and at the same time establish a relatively independent supervision and accountability mechanism and introduce a multi-subject supervision mechanism.It is expected to benefit the rule of law construction of China’s service auxiliary police. |
