Research On The Legalization Of Urban Electric Bicycle Management

In recent years,the number of electric bicycles in major cities has increased.According to statistics,the population of electric bicycles in China has exceeded 250 million.However,kinds of social problems,such as over-standard electric bicycles,frequent traffic accidents,the cognizance of civil liability and criminal responsibility are becoming more and more serious.This has also brought great troubles to local governments,so it is necessary to improve the current management measures by means of the law.In the traffic management aspect,years of practice have proved that the Electric bicycles Limitation Policy cannot solve the related problems fundamentally.Correspondingly,the prohibition order of comprehensive blockade is suspected to violate the relevant provisions of the current law.In addition,there is a big controversy about its legitimacy and rationality.Also,there is no clear stipulation on the legal attributes of excessive electric bicycles,which leads to difficulties in identifying civil and criminal liability in traffic accidents caused by electric bicycles.Therefore,we need to keep pace with the times,from the aspects of strengthening production supervision,improving relevant law systems and regulations,strengthening road supervision and improving the safety awareness of electric bicycle users to introduce more elaborate and humanized regulation schemes,striving to improve both the legal efficiency and social efficiency at the same time.The new national standard has been fully implemented this year,but the corresponding national policy for over-standard electric bicycles is not perfect.Therefore,special management plans for over-standard electric bicycles currently in use need to be formulated to ensure the smooth transition of such vehicles and to maximize the protection of the vital interests of citizens.
