Research On The Legal Issues Of Maritime Law Enforcement Cooperation In The Disputed Waters Of The South China Sea

With the development of society,the use of the sea by countries is increasing.Conflicts related to ocean sovereignty in various regions are also becoming more common.China has had sovereignty over the islands of the South China Sea since ancient times.However,after the 1970s,with the continuous discovery of marine resources and some defects in the system of the law sea of the sea,coastal countries in Southeast Asia began to attach importance to their rights and interests in the South China Sea,and thus triggered disputes in the South China Sea.At present,all countries in the South China Sea dispute waters have deployed law enforcement forces.However,the enforcement activities of law enforcement agencies in disputed waters usually take the oath of sovereignty as the main purpose.Therefore,the conflicts between law enforcement agencies of various countries and the rise to diplomatic events are quite common.The main reason for this phenomenon is the lack of cooperation in law enforcement in the disputed waters of the South China Sea.Currently,the main reason for the dilemma of law enforcement cooperation in the disputed waters of the South China Sea lies in the flaws in law enforcement subjects and law enforcement procedures.In addition,the limitations of international law of sea are also the reasons for the difficulties in cooperation in the disputed waters of the South China Sea.In order to promote law enforcement cooperation in the disputed waters of the South China Sea,all countries should uphold the basic principle of cooperation such as the principle of national territorial sovereignty,the principle of equality and mutual benefit,the principle of specific matters,and the prohibition of the principle of force.All the countries should negotiate a cooperation agreement based on economic cooperation,clarify the main body and procedures of law enforcement and establish a law enforcement cooperation dispute resolution mechanism.In addition,China should be actively invited to play an active role in the process of law enforcement cooperation at sea in order to effectively implement the law enforcement cooperation in the disputed waters of the South China Sea and maintain regional peace and stability.
