Study On Tourism Regulation Design Based On The Investigation Of The Tourist Guides' Protection Of The Rights And Interests In Ganzhou City

Since the reform and opening up,the national income has continued to rise.The demand for travel has increased substantially.Tourism is developing rapidly.China has opened the door of the era of mass tourism.However,because of the complex reasons,the relationship between guides and tourists has evolved from the original interdependence to the situation of mutual prevention and even sharp opposition.The fundamental reason is that the system of tourism legislation in China starts late,and the standard is not good enough.It has no reference to the practice of the tour guides and the protection of the rights and interests of the tourist guides,but also has no detailed rules for the implementation of the existing laws and the regulations of the industry.Even if the state promulgated the "tourism law",the new situation is still endless.The "tourism law" unable to meet the actual needs of the tourism activities,and can't play its due role and protection function,seriously lagging behind the requirements of the development of the times.Because of the emergence of "unreasonable low price" in the tourism industry,on the one hand,the legitimate rights and interests of the tour guides are not guaranteed in this kind of vicious competition.On the other hand,there are often cases of abusing tourists and forcing consumption to harm the interests of tourists in the tour guide group.The social repercussions are great and it has a bad influence on the tour guide team.Therefore,I hope to study and explore the tourism legislation through the study of the protection of the rights and interests of the tour guides in Ganzhou city,and provide meaningful information for the tourism legislation in China.On the basis of the research,through the literature research,the questionnaire survey,the deep interview and the small discussion,this paper extensively investigates and collects the relevant information about the protection of the rights and interests of the tour guides in Ganzhou,and summarizes the protection of the rights and interests of the tour guides in Ganzhou according to Maslow's theory of demand level and other basic theories.The study shows that the lack of tour guide demand is reflected in the primary stage,intermediate stage and advanced stage of Maslow's hierarchy of needs theory.The research holds that the difficulties in the rights protection of the tour guides are characterized by the tortuous process,the bad environment and the poor channels.The reasons for these problems lie in the lack of national legislation,the bias of the law enforcement behavior,the failure of the industry organization to play a role,the industry rules of the tourism enterprises to be perfected,and the weak awareness of the rights of the practitioners.To this end,this article advocates the design of legislation for the protection of the rights and interests of tour guides in Ganzhou: focus on the formulation of local regulations such as "Ganzhou guide regulations" and other local regulations,design guide practice protection system and incentive system,for the upper law,such as "tour guide law","guide personnel management regulations" to make and modify the exploration,sum up beneficial.Experience;formulating the industry standard of the Ganzhou tour guide association,making a strong backing for the protection of the guide rights and interests,and on this basis,put forward the supplement and perfection of the current national tourism laws and regulations.
