Research Of China's Personal Information Protection Institutional System Under The "Overall National Security Concept"

With the advent of the era of big data,almost everyone's life is connected with big data and the Internet,which brings unprecedented convenience to work and life,but also brings many personal information security risks,resulting in personal information is illegally collected,abused,traded and other infringements and crimes occur frequently.Since the establishment of China's "Overall National Security Concept",the main body of national security has changed from a single "main" body to multiple subjects including citizens,and "personal information security" has also become one of the primary factors of national security.At present,the issues related to the protection of personal information and personal information rights have gradually become research hotspots in recent years.The existing researches are mostly from the perspective of specific legal and technical protection,which is not comprehensive and systematic.Therefore,based on the concept of "Overall National Security Concept",perfecting our personal information protection system is of great significance to personal information security and national security.This article will use the literature analysis method,statistical method and inductive method to revise and add the new national security areas in China,including national security,political security,economic security,cultural security,social security and information security,since 2013.Personal information protection laws and regulations and national standard documents are sorted out.The three-dimensional framework of China's personal information protection system is constructed,analyzed and evaluated from three dimensions: traditional and non-traditional security,domestic and international security,legislative system and national standard system.In-depth analysis of the relevant personal information protection rules,explore the current system framework and development trend of personal information protection in China,combinedwith China's actual national conditions,and put forward practical suggestions for improving China's personal information protection system.Through an in-depth analysis of China's current personal information protection system,it can be seen that China's personal information protection system under the overall security concept is developing along different national security fields,different rights subjects,objects and scopes,and has gradually formed six major security In the field,the government and enterprises in different industries have a joint framework for offline and online joint governance of personal information violations.However,there are still corresponding problems in the legislative system and the standard system.Lack of a special law with "legal" effect-"Personal Information Protection Law".The currently published expert recommendation still needs to be improved.At the same time,there is a lack of legislation related to the opening of government data and personal information protection in cross-border data flows;the system of personal information protection standards is not yet perfect,the existing standards are inconsistent in the definition of concepts,and the standards for personal information protection in cross-border data flows still exist To improve the space and make corresponding suggestions.
