Research On Causes And Development Trends Of Double-Sets System Of Electronic Records

"Double-sets System" has been commonly used so far as the electronic management mode in our country.While with the practice of electronic management getting further,the drawbacks of "Double-sets System" are becoming visible.So we need to rethink and examine a series of questions about "Double-sets System".Firstly,the thesis is started with both view of recording technology development and the legal point,through explaining and teasing the basic concept and connotation of "Double-sets","Double-sets System",I try to clarify and make the academics fuzzy cognize of "Double-sets system" clear.Thereafter,I elaborate the basic properties of electronic records as a focal point,analyze the cause of formation about"Double-sets System" technically.On the other side,state the rule of evidence and probative force,then explain the cause of formation about "Double-sets System" from a legal perspective.Therefore,on the theoretical?technical and legal perspective,it is able to respond that why there is widespread implementation of "Double-sets System" during the electronic records management process in our country.Upon that,according to the reality of the implementation of "Double-sets System",I sum up the model and defects of "Double-sets System" concretely and systemically.Meanwhile,by analyzing and learning from the trend of development in electronic records management of foreign countries,it can be proved that the"Double-sets System" is unsustainable,which would not last for long,and would eventually transform from into "Single-Set System".At the same time,I propose a few of technical and legal conditions for realizing the transition.The thesis is divided into four parts.The first part is exordium,which is summarized mainly about research background,research status at home and abroad,the significance of the research and innovation.The second part is begun with the discussion about the concept in academics,then I give the definition of "Hard Copy"?"Double-sets" and "Double-sets System" scientifically,and explain the two-dimensional intension from technical and legal angle.In the third part,combining to the fundamental property of electronic records,I point that the fragile and unstable feature of electronic record raises concern for the authenticity and integrity of itself.Focusing on technical and legal reasons of "Double-sets System",in my opinion that our country lacks the technical competence of which can maintain the authenticity and readability for long term and legal recognition of effect of evidence,both of them are the two root causes.In the fourth part I firstly analysis the model of running in"Double-sets System" by means of statistics to state the degree of dependence on it,then present the disadvantages and huge risks which exists in "Double-,sets System",and demonstrate its unsustainability further.Comparing with international practice of "Single-set System",I conclude that "Double-sets System" will definitely transform into "Single-set System".Totally,I give a certain claim and condition forward that if our country would turn into "Single-set System",we must have improvement and innovation on technology and legislation.
