The disciplinary power of physical education teachers is a powerful guarantee to maintain the smooth development of school physical education and an effective means to achieve educational goals.However,due to the lack of legal guarantee mechanism and the impact of social awareness,the legitimacy of the exercise of disciplinary rights of primary and secondary school PE teachers has been strongly questioned and is on the verge of loss.In order to realize the modern transformation of the disciplinary behavior of primary and secondary school PE teachers and promote the rational return of the disciplinary rights of primary and secondary school PE teachers,it is necessary to solve their practical difficulties in PE classroom teaching from the root.Therefore,this article mainly starts with the concept of teacher's disciplinary power to determine its basic boundary,and based on the theoretical basis of education disciplinary,combined with the actual situation problems,objectively analyzes the current development status of primary and secondary school physical education teachers' disciplinary power,excavates the deep causes of the difficulties in exercising the disciplinary power,and on this basis,puts forward the breakthrough path.This research is mainly carried out from the following parts:The first pat is foreword.Firtly,the research cause has been dipected from the following three parts,which are theory,practice and individual interest.Secondly,research object and value have been analyzed in combine with the plight in punishment right faced by P.E.teachers and core concepts have been explained.Last but not least,paper reviews have been classified based on the academic achievements both at home andabroad.The second part is research object and method.The research object is the punishment right by conducting 220 students and 120 teachers of 15 primary and secondary schools in Hunan and Guizhou province.The literature material law,questionnaire method,interviewing method,mathematical statistics method and expert consultation method have been used aimed to seek the root of the punishment right problem and solve it.The third part is a survey of the current situation of the use of disciplinary power by primary and secondary school PE teachers.This paper mainly makes an investigation and study on the actual use of the disciplinary power of primary and secondary school physical education teachers from the following aspects: the frequency,basis and purpose,the choice of methods,the effect of implementation,influencing factors,legal protection,demographic characteristics,etc.The results show that the frequency of the disciplinary power is low.The exercise of punishment power lacks clear legal basis,the purpose of punishment is not clear,and there is a phenomenon of joint punishment.Disciplinary methods mainly include physical punishment and task-based punishment.The implementation of punishment can play a certain educational significance;The most important factor affecting the exercise of disciplinary power is the attitude of parents.The exercise of discipline lacks corresponding legal protection;There are obvious differences in the frequency of disciplinary rights used by primary and secondary school physical education teachers in different gender,age,cultural level,professional title level and region.On the whole,the current situation of the use of disciplinary power for primary and secondary school PE teachers is worrying and needs to be paid attention to by relevant departments.The fourth part is a probe into the problems existing in the use of disciplinary rights of primary and secondary school PE teachers.On thebasis of the overall understanding of the current situation of the use of the disciplinary power of primary and secondary school physical education teachers,this paper puts forward several main problems in the use of the disciplinary power of primary and secondary school physical education teachers,including unclear standards,basis and scope of the exercise of the disciplinary power,public opinion and educational administrative pressure,lack of protection of the legitimate rights and interests of physical education teachers,improper use of the disciplinary power of primary and secondary school physical education teachers,students' own problems,and parents' attitudes towards the disciplinary power of physical education teachers.The fifth part is an analysis of the factors that affect the reasonable exercise of disciplinary power by PE teachers in primary and secondary schools.This paper mainly analyzes the factors that affect the exercise of disciplinary power by PE teachers in primary and secondary schools from four aspects: legislation,society,schools and PE teachers themselves.The influence of legislative factors is mainly manifested in the current state has not yet formulated laws and regulations related to discipline,the boundaries of teachers' disciplinary rights are not clear,and the educational litigation and complaint relief mechanisms are not perfect.The influence of social factors is mainly manifested in the attack of public opinion on the disciplinary behavior of primary and secondary school physical education teachers,the influence of traditional education views and teachers' views,the cognitive bias of parents and students towards disciplinary rights and excessive rights protection.The influence of school-level factors is mainly manifested in the unbalanced construction of the school disciplinary system,many misunderstandings in the people-oriented education concept,and unreasonable assessment and evaluation mechanism for physical education teachers.The influenceof physical education teachers' own factors is mainly manifested in some primary and secondary school physical education teachers' vague cognition of discipline and corporal punishment,improper exercise of discipline power,and lack of self-reflection and confirmation of discipline power.The sixth part is the measures and suggestions to regulate the exercise of the disciplinary power of primary and secondary school PE teachers.Based on the investigation of the current situation of the disciplinary power of primary and secondary school physical education teachers and the analysis of the causes of the problems,this paper mainly puts forward countermeasures and suggestions from the four aspects of legislation,society,school and itself.The legislative level mainly includes establishing the legal status of teacher's disciplinary power in the upper law,clarifying the legal boundaries of teacher's disciplinary power,formulating specific implementation rules of teacher's disciplinary power,and establishing and perfecting the supervision and relief mechanism of teacher's disciplinary power.The social level mainly includes the publicity of the positive role of teacher discipline by public opinion,strengthening the legal education and study of discipline for students and parents,building an effective platform for home-school communication,and establishing a perfect legal relief channel for education and discipline.The school level mainly includes the construction of an operable school disciplinary system,the sharing and learning of school physical education disciplinary cases,the standardization of physical education teachers' disciplinary behaviors,and the improvement of the scientific mechanism of physical education teachers' disciplinary rights.Teachers' personal level mainly includes strengthening their professional ethics,strengthening their own legal concepts,improving the comprehensive quality of education and punishment,and completing theself-confirmation of punishment right.
