Research On The Causes And Countermeasures Of Domestic Violence Crimes In China

Compared with general violent crime,domestic violence crime,as a crime that infringes on the rights and interests of family members,has certain particularity.Domestic violence crime will not only cause the victim’s physical and mental damage,but also seriously affect their normal study,work and life,and even make the victim have a fear of marriage and family.Many victims of domestic violence suffer from the abuse of domestic violence for a long time,and are finally forced to take the criminal road of "using violence to control violence",which is really painful.The author analyzes and studies the phenomenon of domestic violence crimes frequently occurring in our society,and selects 226 typical cases of domestic violence crimes published by China referee website in recent four years.Based on the empirical analysis of 226 typical cases of domestic violence crime,this paper extracts the common characteristics of domestic violence crime in China at present,and obtains the reasons for the generation of domestic violence crime.The paper is divided into four parts:The first part is the overview of domestic violence crime.In this paper,the three concepts of family,domestic violence and domestic violence crime are defined theoretically,and then the characteristics of domestic violence crime are further expounded.The second part takes 226 cases of domestic violence crime as sample to analyze the present situation of domestic violence crime in China.This paper summarizes and summarizes the characteristics of domestic violence crime in China in the aspects of the crime of domestic violence involving the crime,the sex characteristics of the criminal subject,the education level,the place where the crime occurred,etc.,and then summarizes the characteristics of 226 cases.The third part analyzes the characteristics of the current domestic violence crime in China based on the sample research and analysis in the second part,and analyzes the specific reasons for the frequent occurrence of domestic violence crime in China by analyzing relevant data and introducing relevant theories in criminology.Finally,the author concludes the main factors,social environment factors and judicial practice factors in domestic violence crime.The fourth part is on the third part summarizes the reason of frequent occurrence ofdomestic violence crime in our country,probes into the countermeasures of domestic violence crime: first of all,by optimizing the safety protection system,strengthen the public security organs of the disposal of domestic violence crime enforcement procedures,to set up the basic database "" family violence file,to strengthen the construction of domestic violence crime prevention system;Secondly,the criminal punishment system of domestic violence crime should be perfected from two aspects: solving the evidence problem of domestic violence crime,clarifying the criminalization standard of domestic violence crime and the principle of discriminating the application of sentencing,and considering the special circumstances.Finally,the comprehensive and effective social governance and relief mechanism is established by building a comprehensive social network system of domestic violence crimes,actively giving play to the leading role of government departments,and actively encouraging social organizations to participate in the anti-domestic violence work,so as to explore and improve the prevention and control measures of domestic violence crimes in China.
