Research On Community Correction Of T City From The Perspective Of Collaborative Governance

In the 1980 s,community correction was introduced into China as a penalty execution measure.In 2003,the pilot work of community correction was carried out in China,which started the localization process of community correction.On December 28,2019,the community correction law of the people’s Republic of China was promulgated,which is the first time for China to carry out special legislation on community correction.It is a milestone event of "localization" of community correction,and also a milestone event in the history of the rule of law in criminal execution,marking that the management of community correction in China has really entered a new situation with laws to abide by.In our country,community correction is the supervision,education,training and assistance of the judicial administrative department to the community correction personnel who are sentenced to control,declared probation,parole and temporarily executed outside prison.It is of great significance to maintain social harmony and stability,promote the construction of safe China,rule of law and modern social governance.This paper takes the management of community correction in T City as the research object,takes the theory of "collaborative governance" as the research perspective,on the basis of combing the relevant literature of community correction and drawing on the previous research results,determines the research ideas of this paper.In the research process,using the research methods of questionnaire,interview and comparative research,on the basis of comprehensively mastering the current situation of community correction management in T City,this paper objectively analyzes the problems and causes of the problems exposed by the community correction work in T City,and puts forward the solutions one by one for these problems,so as to provide useful reference for improving the management mode of community correction in T city.In this paper,we find that as a city with an early start in the management of community correction,there are three major problems in the practice of community correction,which are the deviation of the understanding of community correction by the subject of collaborative governance,the imperfection of the mechanism of collaborative governance and the inadequacy of the professional nature of the subject of implementation.Among them,the subject of collaborative governance has the problems of government-oriented and the public’s socialized penalty There are some problems in the mechanism of collaborative governance,such as the disunity of governance idea,the hidden danger in the division of governance function,the unsystematic governance policy,the weak collaborative governance,the lack of professional talents and the low participation of social forces.Therefore,this paper proposes that the community correction work should perfect the main body construction,solve the connection problem,and build a new model of multi-party collaborative governance,in order to benefit the community correction work in China.
