Research On Criminal Law Regulation Of Internet Rumor

The rapid development of Internet technology brings great convenience to people,but it also brings a series of negative problems at the same time.With the rapid development of the Internet,it is more convenient and fast for the general public to express their opinions and communicate information.They break through the limitations of time and space by public platforms like microblog,WeChat and so on.However,the convenience of information transmission also brings the lack of constraints.In order to pursue the speed of information transmission,netizens often ignore the authenticity of information when forwarding it,which leads to the cyberspace is full of complex information and the number of Internet rumors has risen sharply.Rumors continue to expand their influence with the help of the Internet platforms and have a wide range of influence.They will do great harm to society when they are out of control.If we take an attitude of laissez-faire,it will inevitably collapse the social moral foundation,which will have a serious impact on individuals,the country and the society that reflects the necessity of effective supervision of Internet speech.Therefore,criminal regulation of Internet rumors is an important way to curb it,which is an important issue in today’s society.This paper starts from the concept of Internet rumors,elucidating the characteristics and the causes.Then exploring the status of legislation and judicial,and analyzing the shortcomings,learning means of criminal law regulation of Internet rumors of other countries,and combined with China’s specific national conditions to put forward concrete suggestions.It hopes to find a way to fight Internet rumors which accords with China’s national conditions of criminal regulation of Internet rumors.Specifically,this paper is mainly divided into the following parts: The first chapter is an overview of Internet rumors.This part is to identify the definition and understand the characteristics and causes of Internet rumors.The second chapter is to analyze the current situations and deficiencies of criminal regulation of Internet rumors.The current situations are mainly analyzed from the legislative and judicial aspects.And the problems in criminal regulation of Internet rumors are analyzed from four aspects.The third chapter is to understand and learn the experience of the criminal regulation of Internet rumors in foreign countries.It mainly studies from civil law countries and common law countries.And the experience will have three aspects to expound.The fourth chapter is to study the principles and measures of the criminal regulation of Internet rumors.The principles are analyzed from three aspects including the restraining criminal law,the consistent principle of responsibility and crime and penalty and constitutionality.Measures on criminal law regulation of Internet rumors mainly include four aspects.It is hoped that an effective regulation of Internet rumors under the framework of criminal law can be established under the premise of fully protecting citizens’ freedom of speech,and combining with China’s actual national conditions.
