On Network Rumor Regulation From The Perspective Of Criminal Law

In recent years, the rapid development of Internet technology, the impact of cyberspace on the real life more and more far-reaching. As the accessory in development of human society, rumors are also continually growing in the network environment. It can be truly felt when we visit the website. Internet rumors are all-pervasive around us, such as ‘Guo meimei’ event, Grab salt storm, EMU threat, ‘Qin huohuo’ and ‘Li’er chaisi’ case. It’s targets include individual citizens to government departments, enterprises, institutions and public safety. Internet rumors are great harmful to citizens’ legitimate rights and social order.Justice has long been concerned in the field of web content, ‘Internet Information Services’,which is criterion of the network information content, had been passed in 2000.After that, a lot of network security management laws were passed, meaning that the legit boundary of network information is gradually established. The Judicial interpretation of defamation and other criminal cases by using internet is promulgated in 2013, in order to controlling internet rumors and cleaning the internet environment. In 2015, Ninth Criminal Law Amendment stepping up the judicial intensity to control internet rumors by adding some provisions. However, the judiciary and regulatory authorities have to face three problems in judicial practice, inadequate regulations, imperfect system and unclear responsibility. Internet rumors have a large living space.The article is to analysis the basic characteristics and classification of internet rumors. It proves the dialectical relations between internet rumors and freedom of speech. It also explores the extension of legally restricted internet rumors based on identifying their real harmfulness. In view of judicial instances, it expounds the problems need to be solved, especially the judicial activities of Public Security Organs in preventing and controlling internet rumors. From perfecting legislation, enforcing laws strictly, social supervision, it proposes reasonable proposals to build healthy, orderly and positive environment in cyberspace by controlling internet rumors.
