Study On The Legal Issues Of Food Safety Supervision Of Online Takeaway In China

Online takeout,also called Internet food-ordering service,as a new service mode of ordering meals,is widely favored by students,office goers and ‘coach potatoes’.However,dueing to the concealment,virtuality of network platform,the universality and diversity of trading subjects and objects,a series of food safety problems are emerging in the online takeout market.The degree and dimension of supervision on the food safety of online takeout in China directly determine whether the market can develop healthily,sustainably and prosperously,whether the health and safety of consumers’ can be guaranteed.It is urgent to explore and solve the problems of legislation and administrative enforcement of food safety supervision of online takeout in China.With the revision of the new Food Safety Law and the Measures for Supervision and Management on Food Safety of Online Catering Service,as well as the institutional reform of the State Council,China’s food safety governance mechanism,especially the safety supervision mechanism of online takeout ordering services,will face a new promotion opportunity.This paper studies the problems of food safety supervision of online takeout in our country,discusses the current situation,necessity,existing legal problems and legal thinking of that in detail.The first chapter summarizes the online takeout’s connotation through its major structure,business model on the background of developing characteristics of the market,and analyses necessity of the supervision on our country’s online takeout food safety;the second chaptersummarizes the legal issues of our country’s online takeout food safety supervision,including the legislative issues,administrative enforcement issues and social goverance issues;Through combing the analysis of the foregoing with some extra-regional countries,the third chapter summarizes relevant legal thinking,aiming at strengthening the legislative protection and perfecting the regulatory mechanism of food safety supervision of online takeout in China,so as to guarantee the legitimate rights and interests of consumers’ and to promote the healthy and prosperous development of the online takeout industry in China.
