Legal Analysis Of Social Co-governance In Food Safety

Food safety is a people's livelihood issue that has received widespread attention in China.Although many legal measures have been implemented in China for food safety,and administrative supervision has been gradually strengthened,food safety incidents have repeatedly appeared,and food safety issues are still widespread.Fundamentally,due to the nature of food safety risks,food safety governance cannot be done by administrative agencies alone.Therefore,the Food Safety Law of the People's Republic of China,revised in 2015,clearly stipulates the principle of social co-governance of food safety,that is,social subjects should be involved in food safety governance,and all subjects including the administrative organs should cooperate with each other,and jointly realize the social public interest of food safety.However,in the three years since the implementation of the new law,social subjects have failed to play the role as the law expected,and food safety governance has not completely changed the single government supervision model.In order to achieve the legislative goal of food safety social co-governance,it is necessary to optimize the legal system of social co-governance and the legal status of co-governing subjects.The first part of the thesis makes a theoretical interpretation of social co-governance of food safety.First,it tries to define the concept of food safety legally.Then it analyzes the characteristics of food safety risk and the basic content of social co-governance of food safety.Finally,it demonstrates the necessity of adhering to the principle of social co-governance in food safety governance;The second part introduces the implementation of the social co-governance of food safety in China,It introduces the legislative system of food safety in China and the system of social co-governance.Then it introduces the status quo of food safety in China.Although the food safety problems has been obtained to a certain extent,they are far from being fundamentally resolved;The third part points out many problems in the implementation co-governance of food safety from the perspective of administrative organs and social subjects.Faced with the complexity of food safety issues,the administrative agencies have difficulties in the law enforcement,and social subjects is facing serious obstacles in the participation of the governance.Finally,for the realization of social co-governance in food safety governance,the fourth part puts forward the optimization from the aspects of social co-governance system and social co-governance subjects.
