| Family education is one of the three pillars of the education system,which,together with school education and social education,constitute the whole of education.Since the reform and opening up,China has gradually attached importance to the role of education.Many legal documents have been issued to improve the status of education and implement education.The current situation of education in China has been greatly improved.In contrast,the legislation of family education is obviously lagging behind,which is not suitable for its important position in modern national education and lifelong education system.Compared with the legislation of school education and social education,family education has not been effectively guaranteed by law in terms of management system,organizational form and material conditions.Our current "marriage law" and "juvenile delinquency" although there are provisions as early as in the law but the terms of the family education is more involved advocacy,lack of maneuverability,and clear and supervision of the main responsibility of the main body,and referring to a number of laws,not system and repeat each other,restrict the development of family education,family education in recent years again from family,society’s attention,establishing system complete the task of family education legislation is particularly urgent.More and more countries attach importance to the importance of family education and promote the development of family education through legislation.This paper will study the definition of family education legislation,the necessity of family education legislation and other related theories,and put forward Suggestions on family education legislation in China,in order to provide theoretical reference for the formulation of family education law in China.The full text is divided into four parts,in addition to the introduction,a total of 30,700 words.The first part is the basic theory of family education.This part discusses the connotation and characteristics of family education,analyzes the relationship between family education and relevant systems,and the function of family education law and the theoretical basis of family education legislation.The second part is the necessity of family education legislation.Based on the current situation of family education in China,this part studies the necessity of family education legislation from several aspects,such as promoting the comprehensive development of minors,correcting their bad behaviors,preventing juvenile crimes,strengthening the responsibility of guardians,improving the legal system of family education,and responding to the public’s expectation on family education legislation.The third part,Family education legislation needs to demonstrate the basic issues.This part discusses the main problems of family education legislation from the following aspects: the name of family education legislation,the basic principles of family education law,the direct subject of family education implementation,the content of family education,the guidance and service institutions of family education and the legal responsibility in family education.The fourth part,Suggestions on family education law in China.This part aims to make Suggestions for the construction of the family education law in China,the main problems in the third part of the argument put forward on the basis of the author’s own Suggestions,contains the name of the family education legislation was confirmed as the family education law,clear the basic principles of family education,expressly provide the direct responsibility of family education,scientific and standardized family education content,clear related institutions specified in the role of family education,family education in the legal responsibility and so on several aspects. |
