Legal Notarization Research

Mandatory notarization is an important legal system with a long history in Latin notarial system, and China has studied the feasibility of mandatory notarization for several times. As a legal system to prevent disputes, notarization ensures the transaction security and fairness, especially in the field of civil and commercial law. Since Notarization Law was promulgated, there are fewer regulations on mandatory notarization in the current notarization system; so to speak, mandatory notarization hasn’t formed clear legal system in our country yet.Throughout our current laws and regulations, there are fewer laws and regulations with definite provisions on mandatory notarization. Analysis of the Notarization Law andprovisions on mandatory notarization are described generally.This paper sets about from the historical origin of mandatory notarization, contrasts thecharacteristics of mandatory notarization in Latin notarization system and Anglo-Americannotarization system with comparative method, and combings the mandatory notarizationsystem and relevant laws and regulations in the representatives of Latin notarization system, including France, Germany and Japan, and puts forward the problems currently existing in our mandatory notarization, then combined with the reality of our country, puts forwardsuggestions on legislation of mandatory notarization, so as to provide legislative reference for our mandatory notarization.
