On The Legal Regulation Of Campus Violence In Primary And Middle Schools In China

Nowadays,violence in primary and middle schools occurs frequently in our country,which has aroused widespread concern of the society.More and more people are aware of the seriousness of this problem.To solve the problem of campus violence,we need to rely on the joint efforts of parents,schools,society and other aspects.More importantly,we need to formulate and improve laws to provide protection for primary and middle school students.However,from the point of view of our country’s legal regulation,there are still some gaps and deficiencies in the relevant laws related to campus violence.Only Tianjin has promulgated and implemented local laws and regulations against Campus violence.As a central legislation,the existing Law on the Protection of Juvenile has many drawbacks,and it’s hard to operate.Its legislative purpose is difficult to achieve,and it has no deterrent and preventive effect on campus violence.Strengthening the legal regulation of campus violence has important theoretical and practical significance for preventing juvenile delinquency and strengthening the protection of juvenile rights and interests.Firstly,this paper discusses the background and significance of the study,systematically analyses the research on the legal regulation of campus violence at home and abroad,and introduces the main research methods,innovations and research framework used in the process of research and writing.Secondly,the legal concept of campus violence in primary and middle schools is defined,and the main types and characteristics of campus violence in primary and middle schools are analyzed,as well as the current situation of the legal regulation of campus violence in China.Thirdly,it expounds the shortcomings of our laws in regulating school violence from four aspects: lack of legislation,non-standard disposal procedures,weak accountability and lack of supporting measures.Fourthly,the United States andJapan,which are mature countries in dealing with the problem of campus violence,are selected to summarize their advanced legal experience in the legal regulation of campus violence,and to refine the content that can be used for reference in the light of China’s national conditions.Finally,on the basis of the legal problems in the process of dealing with campus violence mentioned above,this paper puts forward some strategies and suggestions to regulate campus violence.Specifically,that is to formulate and amend relevant laws,unify the disposal standards,clarify the legal responsibilities of each subject,and further improve the supporting measures.
