The Research On The Legislation Problems Of Anti-campus Bullying In Our Country

At present,the frequent occurrence of campus bullying in our country has aroused widespread concern in the community.Campus bullying with its specific forms including verbal slander,beating and extorting,always occurs among students,which involves severe bully,oppression and suppression,and it is invisible and multible and often causes great harm to the victims and their families both physically and mentally.Campus bullying has become one of ferocious diseases in our country.However,our country is not only backward in the theoretical research,but also has a large lag in the legislation of bullying.Although in 2016,China has successively promulgated two legal documents,including the Implementation of Special Notification on the Management of Campus Bullying and Guidance on Middle School Students' Prevention of Bullying and Violence,but both of them only play a guiding role,and give some suggestions,but they have exerted faint effects.Our current law also has provisions on campus bullying,but these provisions are scattered and vague,lacking of legal concepts,and revelant legal documents ranks very low.What's more,the supervision mechanism,the relief system and the implementation mechanism of law are all not perfect,which causes the result that they often deal with the cases of bullying through mediation,and it can not protect the legitimate rights and interests of victims effectively.Compared with other countries and regions,the legislation of bullying in schools,especially in the United States,Japan,Britain and Taiwan,provides a good reference for our country's bullying legislation.Based on the present situation in our country and foreign advanced legislative experience,and with the reference to the principles of equality,zero tolerance,early prevention,and combining education and punishment on bullying legislation,and the specific regulation of the content of the definition and types of bullying and relevant subject responsibilities,the supervision mechanism and relief methods are clearly defined,and with the introduction of American campus bullying declaration system,we can develop a targeted,comprehensive Anti-Bullying Law,in order to better solve the problems of bullying in China.
