Study On Marriage Law Protection Of Divorced Women’s Rights

Marriage and family are very complicated fields.Almost everyone hopes that they can have a happy marriage.However,the ideal is full and the actual skin is so natural that the ideal is often fragmented by the impact of reality.The ability to run a marriage is not inherent to everyone.According to each person’s ability to handle intimate relationships,everyone’s sense of well-being varies.The "Marriage Law" directly guides people’s ideas and behaviors.With the continuous improvement of the country’s economic level and people’s living standards,women’s status has also improved over the past.However,the divorce rate has increased year by year,and problems such as "third party" and "property of property division" in marriage have become the focus of the society.The rights of divorced women have also received universal attention from the society.In particular,after the introduction of “Marriage Law Interpretation III”,the property issue between husband and wife was newly defined,for example,the ownership of real estate acquired by a parent before the marriage for the child’s purchase of the property.The promulgation of this judicial interpretation has caused great controversy.Although the provisions stipulate that men and women are equal in form,they do not consider the difference between male and female social division of labor and physiological functions.In addition,China’s“Marriage Law” still has diversified women’s property protection scope,lack of fair and reasonable economic compensation,children’s access rights and custody rights received damages,and so on,due to physiological differences between men and women and different social division of labor.The legal system that determines the "Marriage Law" to simply equate the two is a manifestation of the substantial equality of men and women.The author understands that many divorced women prefer to leave their homes in order to secure the custody of their children when they divorce.However,single mothers who raise their children alone must face not only the gender discrimination and economic distress of China’s social employment at the current stage,but also fullness.Suffering from emotional deficiencies and social cold eyes.Many divorced women not only have to play a good mother role in their lives,but also take responsibility for their father’s role in order to grow up.Therefore,divorced women are still the weaker group that our society should pay attention to.In this article,the author uses gender analysis,empirical analysis,comparative analysis to examine China’s current Marriage Law,specifically analyzes the provisions and deficiencies of China’s current Marriage Law on the protection of divorced women’s rights and interests,and points out the problems in the protection of divorced women’s rights and interests.Besides,The author has made a comprehensive study and investigation on the relevant provisions of Western legislation on the rights and interests of divorced women,and draws on foreign regulations on the protection of divorced women,and puts forward suggestions based on the actual situation in China.On the basis of analyzing the main problems of the specific system of marriage law and the protection of women’s rights and interests,this paper puts forward suggestions on perfecting the system of protection of divorce women’s rights and interests in China’s Marriage Law.
