As a developing country with the largest population in the world, China has more than600million women, accounting for about a quarter of the world’s female population. Reform andopening up three decades, accompanied by sustained economic growth and social progress,economic participation of women in construction, poverty eradication, health maintenance, theestablishment of marriage and family, protect and improve the environment, plays a pivotal role.However, due to the traditional role of men and women formed long-term socialdevelopment, personal rights and interests of women in marriage and family still do not getadequate protection. domestic violence, sexual assault, reproductive rights are violated, etc.,which are reflected in our current marriage and family, and therefore, This article is basedwomen’s rights embodied in marriage and family, the analysis of specific status of women in ourcountry have been violated, combining Western society in the legislative and judicial practice,integrated our equity method currently available for women, from the perspective of thelegislative strategy on how improvement of women’s domestic interests analysis, reflection, findthe best perfect way to provide suggestions for solving women’s rights infringement.Paper includes four aspects:The first part: the personal interests of women in marriage and family overview. Productionactivities in the community, women not only enjoy a personal interest in the law, but also haveadditional rights, such as reproductive rights. The new "Marriage Law " clearly states: marriageand family in the new era of socialism, both spouses have equal status, women enjoy equalpersonal interests with her husband in marriage.Part Ⅱ: Analysis of personal rights and interests of women in marriage and family against thestatus quo. Affected feudal traditional concept of " patriarchal " thinking is still deeply rooted inpeople’s minds. Many Chinese women ’s personal rights and interests are infringed still onvarying degrees in marriage and family. Including the right to health of women, spouses rightsand reproductive rights in marriage and family in this section involve the relevant examples toexplain the current status of the various interests in the presence of women being infringed.Part Ⅲ: Western women in marriage and family law to safeguard the personal interests ofcomparison.
