The cross-strait marriage has a long history. After 1949 , it was suspended for the political reasons. Until 1987 , the Taiwan authorities allowed the Taiwanese to visit relatives in mainland China , the two sides resumed marriage. Due to the historical , economic and other reasons, in most cross-strait marriage, mainland women married Taiwan men , those mainland women suffered from long-term discrimination and unfair treatment.In the continuation of their marriage, their legal rights have not been entitled to effective protection; not to say, if the marriage is ruptured, their rights can not even be guaranteed. All these show that the protection for the mainland spouses'rights in Taiwan is in a state of absence, the problems and difficulties in their marriage can not be ignored, therefore, it is necessary to put the safeguards for the rights of the mainland-female -spouses on the agenda.There are three chapters in this dissertation besides introduction and conclusion.In the introduction , I briefly introduced the reasons for writing this dissertation.Chapter One is about the establishment of Taiwan-related marriage. By examining the status of Taiwan-related marriage , comparing the different marriage systems between Taiwan and mainland China, I find that different marriage system can influence the protecting of women's rights. Based on this finding , I make a suggestion: protecting women's rights form the sourceThe second chapter is about the protection of women's rights for Taiwan-related marriage. In this chapter I analyze the obstacles the women's faced in Taiwan-related marriage , that is political policy barriers , discriminatory institutional barriers , economic barriers and the cultural and conceptal barriers. Directed to those obstacles, I propose some measures and suggestions on how to solve those obstacles and protect women's rights.In chapter three is about the safegurads for women when the Taiwan-related marrage is terminated.I discuss the problems in protecting women's rights when the Taiwan-related marriage is terminated.Here I put the emphasis on analyzing when the marriage is terminated , the problems in implementing and protecting the mainland spouses'rights, that is the interregional conflicts in laws , the problems in sending judicial documents and the mutual recognition and enforcement of the civil jurisdiction between Taiwan and Mainland. Than I focused on the problems in implementing and protecting the mainland spouses's rights when the marrage is terminated, and propose some solution, including the conception in solving the regional conflicts on marriage law, the cooperation between Taiwan and Mainland in sending the judicial documents and the mutual recognition and the improvement and refining of the enforcement procedures .Finally, in conclusion , I reviewed the general idea of this dissertation , showing the regrets and confidences in implementing and protecting the mainland spouses'rights.
