The loss of judges is widespread in China,and the loss of the basic-level judges is even more serious,with new round of judicial reform of the Supreme People’s Court.This paper selected samples of basic courts of urban society in regions with relatively developed economic as the research objects.And the paper used empirical research,questionnaires,case studies,and other legal empirical research methods,and the legal methods of criterion analysis,so as to analyze the reasons for the loss of the sample court judges thoroughly,and get the common cause of the phenomenon from local courts.By doing so,the judicial reform measures will truly be put into practice,which will bring benefits to basic courts and judges.And theoretical supports will also be given to realize top-level design goals.The focus of this paper is to analyze the current situations,causes,and characteristics of the loss of the basic-level judges,and also provide some suggestions.First of all,the author found that due to the fact that the loss of the judges’ team in the sample court was quite serious and most of them were the backbone talents,and the phenomenon was becoming more extreme,causing the consequence that the grass-roots courts were in a state of passive compensation,which impaired the judge’s sense of professional respect and influenced the quality of the trial work of the grass-roots courts;Second,the causes of the loss were complex and diverse.It can be divided into the following kinds: the first dictionary factor was that increased number of grassroots court cases due to social population growth,economic development,and registration reform was not coordinate with the insufficient overall staff of judges at the basic level,fewer judges in leadership positions,and changes in case assignment rules;The second factor was the dictionary factor was the judges’ professional bottlenecks and judges’ income gap,due to judge’s rank and administrative level;The third factor was the constraints of local party and government agencies and higher courts on grassroots courts and grassroots judges,under the administrative system;The last factor was that the deviation of practice in the reform of the judges system,led to the irrational allocation of trial resources in the primary courts;To summarize,based on the above factors,stabilizing the basic judiciary judge team should start from the system-level improvement and the perfection of judge occupational protection.On the one hand,it is necessary to reform the hierarchy of judges to smooth the channels for the promotion of judges,further increase the income and welfare of judges,and reasonably define the judicial responsibility system so that the powers,responsibilities,and responsibilities of judges can be unified.On the other hand,it is necessary to improve the independent status of grass-roots courts and grass-roots judges to remove them from the shackles of administration,and improve supporting measures for the judge system reform to ensure the rational allocation of trial resources.The unified design and classification of the referee’s standard under the courtroom will ensure the quality of the trial and reduce the pressure on the judges.
