The Plight And Outlet Of The Rule Of Law In Asia

The practice of regional rule of law already exists,but the theory of regional rule of law as the original theory of China in the 21st century,which is active in the international arena,is being closely watched by international legal scholars.In addition,due to Asia as a typical representative of non-western,east-west cultural differences in the kernel makes its way to the rule of law is difficult to copy western existing regional model under the rule of law,and gradually rise of the east,the concept of the rule of law gradually into the heart,to determine the future of the rule of law construction.Therefore,through the discovery of the status quo of the rule of law in Asia,this paper studies the construction of the rule of law in Asia in combination with the main difficulties in the development of the rule of law in Asia.The thesis is divided into five parts.Stated in the first part mainly expounds the regional research background,research significance of rule of law,and the review and the review of the literature of related field,summarized the current research status quo of the problem,and the evaluation and comparison,points out that the predecessors have not in-depth research content at the same time,put forward new research perspective.The second part mainly elaborates the concept of regional rule of law under international rule of law.This part introduces the specific meaning of the concept of the core area of the rule of law of the article,and expatiates the international rule of law and the relation of the rule of law shows the area unique under the rule of law,and then by means of analyzing regional function and position of the rule of law in the international rule of law,demonstrates the significance of regional research on the international rule of law under the rule of law.The third part mainly analyzes the status quo of the rule of law in Asia.This part first describes the reasons for the study of the rule of law in Asia.Secondly introduces the main status quo for the development of the rule of law in Asia,and by analyzing the status quo of Asian law of the road of progress background under the rule of law,the basis of the practice of the rule of law in Asia answer.The fourth part mainly discusses the predicament of the development of the rule of law in Asia.Combined with the second part,summarizes the current Asian design level of the rule of law and the rule of law in the process of implementing the rule of law development level,the main difficulties and the reasons for the formation of related difficulties has carried on the detailed studies.The fifth part mainly discusses the construction of the rule of law in Asia.The part two,part three concludes the implementation of the rule of law in Asia is divided into some stages,namely further condensed regional consensus rule of stage,seize opportunities for regional charter phase of the rule of law and the rule of law is law practice area seriously good governance stage,through the three stages of progressive,contrast type,depicts the Asian path figure in the development of the rule of law.Puts forward,in this case,to solve the present existing problem of real-time in the rule of law to explore,to deepen regional consensus under the rule of law,deepen the degree of the rule of law construction,strengthening regional internal cooperation and contribute to the habits of interdependence among the members of the area,get the opportunities to develop regional charter law,gradually upgrade the rule of law in the region is systemized,eventually will certainly to move towards the harmonious state of the rule of law ought to be in Asia.
