The Litigious Activities Of Intellectuals And Local Judges' Administration Of Justice In Song Dynasty

Ming Gong Shu Pan Qing Ming Ji is a compilation of official documents classification and litigation judgment.This book not only for the study of the Song Dynasty especially in the Southern Song Dynasty's social history and cultural history and legal history are very intuitive and precious historical value,but also from the intellectuals involved in the litigation behavior of exploring the subtle relationship between the Song Dynasty scholar system and potential system.In the ancient Chinese intellectuals had their own cultural traditions,especially in the Song Dynasty.At the same time,the trial of the intellectual in the Song Dynasty had a great influence on the judicial activities of the Song Dynasty,which caused a complex tangle between the imperial power and the official system.In this paper,Ming Gong Shu Pan Qing Ming Ji as the research object,the research on the litigation records intellectuals case,cause analysis of Song Dynasty's intellectuals engaged in judicial activities and the activities of judicial trial in Song Dynasty.In the famous scholar's behavior is against the intellectuals involved in the litigation but influenced by the traditional Confucian culture,the scholars approach the participation in punishing litigation intellectual use leniency in meting out punishment,reflecting the public pursuit of the social ideal of "no litigation".
