Research On Current Situation,Problems And Countermeasures Of Medical Disputes Disposal

With the gradual increase of people's health needs and the enhancement of legal consciousness,Conflicts between doctors and patients are common,and medical disputes become more and more serious.It not only affects the normal order of hospital and the harmony of doctor-patient relationship,but also affects the healthy development of China's health industry and the unity of the socialist society to a certain extent.Therefore,how to solve medical disputes has become an important question for the party and the government.At present,there are four legal ways to deal with medical disputes in China:consultation between the two parties,people's mediation,administrative mediation and litigation.but in practice,the disadvantages of these ways are constantly exposed.This article starts from the current situation of medical dispute disposal,and takes Z hospital of S city as an example.Using social conflict theory,crisis management theory and collaborative governance theory,and using literature research method,comparative research method,questionnaire survey method and inductive summary method.The main problems in the current process of medical dispute settlement are found and analyzed as follows:the consultation between hospital and patients is easy to intensify contradictions,and the binding force of the settlement agreement is low;the people's mediation is not professional and neutral;the credibility of administrative mediation is not high,and the trend of marginalization is obvious;the litigation is time-consuming,but the effect is not very well.Through deep thinking on the causes of these problems,some opinions are put forward:Establish a reasonable system for handling disputes in the hospital,Reasonably perfect the relevant system of medical liability insurance to give full play to its role,multi-sectoral collaborative disposal of medical disputes and the establishment of arbitration mechanism for medical disputes and other aspects of thinking,finally put forward four current statutory ways of medical disputes disposal ideas and countermeasures.
