PurposeThe purpose of this paper is to investigate sample hospital implementation of informed consent in an emergency situation,to clarify its deficiencies in the process of implementation,and propose specific measures to improve the implementation status of informed consent in emergency situations in this sample hospital from the perspective of hospital management optimization and legal risk avoidance,so as to reduce medical disputes and ease the doctor-patient relationship.MethodsThis paper adopts the methods of literature analysis,phenomenon observation,and questionnaire survey.This paper further clarifies the problem by literature reviewing,specifying theoretical basis researches,conducting internship in samples of hospital,and carrying out questionnaire survey for 390 patients and 210 doctors.ResultsThe Group of Doctors1.The variance analysis showed that the difference was statistically significant.The older the age of doctors,the better their job title and the higher their monthly income,the higher the overall cognitive score.2.In terms of the choice of procedure of informed consent,even in emergency situations,most of the doctors' choice is still based on the law regulations.3.In terms of the substantive problem of informed consent,the tendency of risk aversion runs through doctors' choices all the time.The Group of Patients1.The variance analysis showed statistical differences.The higher the monthly income and the higher the educational background,the higher the overall score of cognition.2.In emergency situations,the choice of patients overlaps with the choice of doctors and legal provisions on a large scale.3.Whether the doctor's treatment conforms to the standard is the preferred indicator for the patient to determine whether to take responsibility or not.4.Individual differences in entity preference selection:chi-square test showed that,in the emergency situation of "uninformed surgery" and "informed refusal of surgery",the differences at each educational level are statistically significant.There was a statistically significant difference among patients depending on the experience.Conclusions1.To improve the internal procedures for the exercise of patients' informed consent in emergency situations(1)Carry out relevant knowledge publicity and education in a targeted way.(2)Expand the emergency identification criteria and establish the primary status of attending physician identification.(3)Clear priorities for informed notification procedures.(4)Improve the internal pre-authorization decision-making mechanism to avoid legal risks.2.External conflict regulation of patients' informed consent right under emergency circumstances in sample hospital(1)Eliminate "uninformed surgery",avoiding expanding the medical paternity in the name of safeguarding the life and health of patients and violating the human rights of patients.(2)Implement of "informed and unintentional surgery" in accordance with the law.The law clearly stipulates that when the patient's opinion cannot be obtained,the medical side can implement the treatment measures after the corresponding approval process.(3)Restricted "informed refusal of surgery",which core principles are analyzed on a case-by-case basis.3.Breakthrough of economic distress of informed consent right of patients under emergency in sample hospitalAt the national legal level,the establishment of disease emergency relief system is needed.
