Study On The Protection Of Legitimate Rights And Interests Of Medical Personnel In Medical Disputes

With the improvement of people's living standard,people pay more attentions to their health in 21 st century,however,the present configuration of medical institutions can not meet the needs of the masses and the national health care reform lags behind,which result in difficulty and high cost of treatment,gradually lost of the confidence between doctors and patients,the doctor-patient relationship trust crisis,violent injury medical events,emergence of endless medical disputes.As medical personnel,when facing medical disputes,the protection of their legitimate rights and interests is particularly important.This study expounds the connotation of medical disputes and the legitimate rights and interests of medical personnel,then analyzes and demonstrates them from the following three points: firstly,to figure out the specific problems in the protection of the legitimate rights and interests of medical staff in the medical disputes in our country based on the illustration of the status of the protection of the legitimate rights and interests of medical personnel in medical disputes from the perspective of laws,regulations and social environment and combination of the specific measures to protect of legitimate rights and interests of medical personnel in medical disputes of A hospital;secondly,to analyze the causes of these problems from legal,social and specific hospital levels aiming at the detailed problems in the protection of the legitimate rights and interests of the medical staff in China.At last,with the combination of China's national conditions and legal norms,I will find solutions and put forward measures to protect the legitimate rights and interests of medical personnel in China's medical disputes.The results show that the main reasons for the violation of the legal rights and interests of medical staff in medical disputes are consisted of : imperfect medical legal construction,abnormal expansion of patients' rights protection,unbalanced distribution of medical resources,defects in medical personnel's diagnosis and treatment,crisis of trust between doctors and patients,and negative effects of media intervention.This paper puts forward the following countermeasures: establishingand perfecting the legal system of protecting the legitimate rights and interests of the obligatory people,improving the scientific management level of medical institutions,and establishing and perfecting the social system of protecting the legitimate rights and interests of medical personnel.
