Regardless of the theory or practices, studies on psychiatrist's rights were relatively weak by the perspective of the medical ethics. Because of the special nature of the medical objects, the medical behavior, psychiatrists have a bigger autonomy compared to common physician, so, infringement on the life and health rights of the patient occurs easily in the social practice.In the current,"Mental Health Act" has not introduced.If we study it from this perspective.wich will accurately definite reasonable meaning by the egal,provide ethical defense to legitimate rights of Psychiatrists,protect the interests of both patients and physician in medical activities,establish a stable and harmonious relationship between doctor and patient. This article is divided into three parts, main content as followed:The first part describes the evolution of psychiatrist right. Firstly, analyze and summarize the concept of rights.The content of legal physician right is too broad.which ignoring the demands of patients, the content of physician right in ethics has a more close to nature of rights. Furthermore, I analysis ethical meaning and rationality of three major right:the psychiatric diagnosis right,medical intervention right and limiting privacy right; then elaborate psychiatrist rights'legitimacy and legality from a logical perspective, which is a historical development, may have chiefly undergone the right to non-moral,purely moral concerning and the full benefits of the patient care; ultimately, summarize that psychiatrists only make the biological, psychological, and social the three dimensions of new medical model integrate to an entirety, which can pay more attention to safeguarding human dignity, to more in-depth of the medical ethics spirit.The second part shows the generalized phenomenon in psychiatric treatment practice, and analysis the deep-seated reasons behind the phenomenon. There are three parts:it exists abuse of the right on account of complex symptomatology standards,physician-patient relationship utilitarian and the absence of medical ethics review; by the lack of psychopath autonomy,psychiatrists social responsibility to enlarge and psychiatrists mood factors, these have contributed to an expansion phenomenon of the medical interference right:mandatory escort admission,the misuse of protective constraints measures,setting barriers to prevent patients from leaving hospital; due to consciousness awareness of the legal privacy protection and ethical confidentiality principle not institutionalized,which lead to the status quo of unreasonable restrictions to patient privacy.The third part solves the problems. In details, it put forward the ethical limits of psychiatrist right:diagnostic techniques abiding strictly by canon of medicine,diagnose disease with the aim to safeguard the legitimate interests of the patient and physician own behavior in accordance with moral principles, which set ethical requirements of targeted. On the whole, it put forward ethical principles of psychiatrist should follow and think the fundamental principles of all medical activities or behavior to respect autonomy of mental patient. In the course of medical behavior, psychiatrists not only adher to the principle of do no harm and benefit, but also must follow the principles of justice and equally make use of medical resources.We should create a good social environment to them, strengthen the medical education to reduce discrimination against mental patient.so.all this will be conducive to help exercise of the right, more make for the maintenance of self-interest of patients.
