The Research On The Present Difficulties And Countermeasure Of The Effective Decision Of The Living Will

With China's aging society approaching,chronic diseases have become the main burden of disease.The number of end-stage conscious patients is far more than acute and severe unconscious patients.Therefore,the meaning of the living will become increasingly prominent.In the discussion of the establishment of the living will in China,the controversial point is whether the living will of the patients in the medical treatment is effective.Through the study and analysis of the effective decision of different countries and regions,the author concludes that there are three main decision modes in the world: patient's independent decision mode,physician's judgment mode and family decision mode.On the basis of this research,through the analysis of the present difficulties and reasons of the effective decision of the living will in China,the main problems are the lack of understanding of the living will,the challenge of traditional ethics,the Legality of the living will and conflicts among patient autonomy,family decision and doctor discretion.This paper through legislative exploration,coordination of right conflic and governmentsupport to put forward the countermeasures.At the legal level,the legalization of the living will,the principle of priority of patient autonomy,and priority of agents from family members.And through setting up pre-negotiation to coordinate the conflicts of right.At the government level,we should first implement it in the form of non-legislation,at the same time improve our social security system and carry out death education.So as to resolve difficult positions and promote the realization of living will.
