Post-legislative Evaluation Of The "Regulations On The Development Of Traditional Chinese Medicine In Jiangsu Province"

Objective:In the context of the promulgation and implementation of the Chinese Medicine Law of the People's Republic of China(hereinafter referred to as the "Chinese Medicine Law"),this paper conducts post-legislative evaluation studies on the Jiangsu Provincial Development of Traditional Chinese Medicine Regulations(hereinafter referred to as the "Regulations").Through the evaluation of the text quality of the regulations and the implementation effect of the main system,the paper provides a theoretical basis for considering whether the regulations need to be revised and improved.At the same time,aiming at the problems in the process of the implementation of the regulations,Combined the characteristics of the development of traditional Chinese medicine in Jiangsu Province,it proposes amendments to the "Regulations" from the aspects of medical services,protection and development of Chinese medicine,and Chinese medicine education,so as to provide references for relevant departments to formulate and revise the local regulations on Chinese medicine and promote the sustainable development of traditional Chinese medicine in jiangsu province.Methods:Firstly,Collecting relevant literatures on the construction of traditional Chinese medicine methods in the existing academic field,and systematically analyze existing medical and health policies to understand the status quo of local Chinese medicine regulations.Secondly,using expert interviews,empirical research and other methods to establish the post-legislative evaluation index system of the Regulations,and use the analytic hierarchy process to calculate the weight of each indicator.Furthermore,according to the established post-legislative evaluation index system,the texts and implementation effects of the Regulations were evaluated,and the problems existing since the implementation of the Regulations were analyzed and summarized.Finally,based on the results of text quality evaluation and implementation effect evaluation,combined with the problems existing in the development of traditional Chinese medicine in Jiangsu Province and the requirement of different Chinese medicine fields for the construction of Chinese medicine legal system,the revised recommendations of the Regulations were proposed.Result:In terms of text quality evaluation,the "Regulations" have good legitimacy,but the overall evaluation in terms of rationality,coordination,operability,characteristics,and normativeness is low,especially in terms of characteristics and norms.Regarding the evaluation of the implementation effect of the main system,the promulgation and implementation of the" Regulations " provided legal protection for the development of Jiangsu Traditional Chinese Medicine and promoted the healthy development of the Chinese medicine industry in Jiangsu Province.However,the "Regulationsr"also have problems such as the decentralization of management functions,the seriousness of Chinese medicine westernization,and the unrecognized education of teachers in the construction of management systems,the development of medical institutions,and the training of Chinese medicine personnel.It needs to be further improved at the legislative level.Conclusion:In view of the results of post-legislative evaluation feedback,this paper argues that the revision and revision of laws and regulations should conform to the principles of legality,rationality,coordination,operability,characteristics,and normativeness,namely the legislative procedure is legitimate,the main system is set up properly,coordinated with the superior law,the content is concrete and operable,the local characteristics are highlighted,the language is accurately regulated,and it conforms to local legislative standards.In addition,for the specific recommendations of the revision of the Regulations,this paper believes that the first is to establish a sound management system for Chinese medicine,to clarify the responsibility of various departments for the development of Chinese medicine.The second is to strengthen the construction of Chinese medicine medical institutions and give full play to the treatment of Chinese medicine.The third is to strengthen the supervision and management of Chinese medicine,to ensure the quality of traditional Chinese medicine from the source.The fourth is to improve the Chinese medicine education system and promote the establishment of an educational model combining college education with teacher education.The fifth is to increase the investment in Chinese medicine to ensure its proportion in health expenditure.And the sixth is to improve the pricing system for Chinese medicine.Reasonably stipulate the price of Chinese medicine services.
