Study On The Connection Between Environmental Impact Assessment System And Environmental Permit System

In 2017,the former Ministry of Environmental Protection issued the Notice on the Work Related to the Connection between the Environmental Impact Assessment System and the Environmental Permit System,which clarified the general idea of the connection between the Environmental Impact Assessment System and the Environmental Permit System,and provided a legal basis and technical guidance for the connection between the two systems.Since the 18 th National Congress,the reforms of the Environmental Impact Assessment System and the Environmental Permit System have been in full swing.The idea of the reform of the Environmental Impact Assessment System is to simplify the administration and decentralize the power,combine the decentralization and control,and improve the efficiency of the Environmental Impact Assessment approval.While the Environmental Permit System is facing a "one-certificate" reform,and the Environmental Permit System should be built into the core of the entire regulatory system for fixed sources of pollution.However,the reform and improvement of systems should not only focus on themselves,but also on the environment as a whole and the connections between the various environmental management systems.Maximizing the functions of the overall environmental management system is a fundamental purpose of the reform.Therefore,in reforming the Environmental Impact Assessment and the Environments Permit System themselves,the interaction between the two systems cannot be ignored.At present,China has basically established the legal basis and practical requirements for the connection between the Environmental Impact Assessment and the Environmental Permit System,but there are still many problems and dilemmas in the practice of specific connection.The problems are mainly reflected in the imperfect legal basis,inconsistent technical specifications and imperfect communication mechanism at the top-level design level.At the specific implementation level,the cohesion objects,contents and procedures are not clear.This article starts with the respective management of the Environmental Impact Assessment System and the Environmental Permit System.Based on the analysis of the advanced connection experience of the United States and Germany,and taking into account China's specific national conditions,it proposes the two general connection ideas of building a whole-process management system for pollutionsources with the Environmental Permit System as the core and promoting the reform of the Environmental Impact Assessment System.The connection of the system needs to come out of the dilemmas.To achieve the connection between the Environmental Impact Assessment and Environmental Permit Systems at the system level,it is necessary to strengthen the provision of legislation,unify the technical standards of the two systems,and establish a national pollution source information management platform to ensure the communication between the two systems,at the implementation level,it is necessary to clarify the key issues such as the target of the connection,the content of the connection,the connection procedures,and the division of powers and responsibilities between the connection management departments.On this basis,the whole process of pollution source management is used as a clue,and through the supervision of the whole life process of pollution source from nothing to something,from something to management,the Environmental Impact Assessment System and the Environmental Permit System are linked together to build the environmental pollution management system connection system.
