Research On Legal Environmental Impact Assessment System

Environmental pollution is increasingly serious nowadays,the world is paying more and more attention to environmental problems,and thus how to effectively avoid the adverse effects of human activities on the environment has become a key problem to be solved.Under such research background,the environmental impact assessment system appears.The strategic environmental impact assessment system is a hot problem of the academic debate.The legal environmental impact assessment system,as an important part of the strategic environmental impact assessment system,can minimize the negative impact of the law on the environment.In order to further improve China's environmental impact assessment system theory,and to better promote the effective implementation of strategic environmental impact assessment,this paper discusses the legal environmental impact assessment system in China based on the needs of social development,environmental protection and legal construction.According to the theory of environmental pollution cumulative effect,pollution prevention theory,sustainable development theory and system theory,by using the literature research method,comparative research method and normative analysis method,this paper studies the object selection system of environmental impact assessment,the theoretical basis of the construction of legal environmental impact assessment system,the feasibility analysis of the construction of China's legal environmental impact assessment system,the idea of the construction of China's legal environment impact assessment system and other specific issues.It is believed that this study will contribute to the improvement of China's environmental impact assessment system.In the study of object selection system of environmental impact assessment,the author believes that the choice of environmental impact assessment objects should follow the guiding ideology of "control environmental pollution and ecological destruction activities from the source" and the basic principle of " consistent with the level of socio-economic development level of social and economic development,effective prevention and feasibility".The author also points out that the basis of the selection of environmental impact assessment object includes environmental impact,evaluation feasibility and evaluation validity,the objects of the present environmental impact assessment are not comprehensive,the object is lack of hierarchy and so on,and the author think that law should be included in the environmental impact assessment system in China.This paper analyzes the theoretical basis of China 's legal environmental impact assessment system from the four aspects of environmental pollution cumulative effect theory,pollution prevention theory,sustainable development theory and system theory,and thinks that it is necessary for China to incorporate the law into the objects of environmental impact assessment.The author analyzes the theoretical research situation,the practice exploration situation and the international experience,concluding that it is feasible to build a legal environmental impact assessment system in China.The author believes that the basic principles of China's legal environmental impact assessment system should include the principle of overall and holistic,purposiveness and pertinence,the principle of dynamic and repetition,that China's legal environment.This paper argues that the value orientation of China's legal environmental impact assessment system includes macro,guiding,perfection and continuity;the main body of the evaluation system of environmental impact assessment in China includes administrative organs,environmental impact assessment institutions,social organizations and experts and scholars;at the same time,it discusses the object system and the evaluation link of the legal environment impact evaluation system in China,and suggests that China 's legal environmental impact assessment system should be progressively realized.
