Research On The Legal Issues Of Compensation System For Ecological Protection Of National Parks In China

A good ecological environment is the material basis for human survival.In the face of various ecological and environmental problems encountered in China in recent years,the 18 th National Congress of the Party put forward the development strategy of "ecological civilization construction" Establishing a national park system as an important part of ecological civilization construction.National parks contain grasslands,forests,wetlands and many other ecosystems.They are rich in natural resources and are important ecological regions to protect biodiversity.Therefore,national parks' ecological protection plays a vital role in ensuring the sustainable development of China's important ecological resources.However,the implementation of ecological protection will inevitably sacrifice the benefits of some people,especially their economic interests.The ecological protection compensation can maintain the balance between ecological protection and economic development through reasonable compensation to the residents whose interests are damaged in the national park.At present,some legislation in China already have provisions for the national park ecological protection compensation system.In 2016,the “Opinions of the General Office of the State Council about Improving the Ecological Protection Compensation Mechanism” comprehensively regulated the ecological protection compensation mechanism,and some results have been achieved in practice.But overall,at present,China's national parks ecological protection compensation system has not formed a complete legal system and lacks specific content provisions.These problems have greatly restricted the development of national parks ecological protection compensation system.This article starts from the perspective of the national park ecological protection compensation system.First,it is an interpretation of the concept of national parks and ecological protection compensation systems,and analyzes the significance of improving the national parks ecological protection compensation system;second,from the two aspects of national park polices and existing legislation to analyze the national parks ecological protection compensation system.It's summarizes the existing laws and the legal problems of the national parks ecological protection compensation system in our country,and provides reference for it from the mature experience of the three countries of the United States,Germany,and Japan;finally,According to the existing problems,this paper puts forwards the concrete conceptionof perfecting the compensation system of national parks ecological protection from three aspects: Accelerating the legislation of compensation system for ecological protection of national parks,perfecting the specific contents of the system and the supervision mechanism.
