Study On Legal System Of Agricultural Land Soil Contamination Remediation In China

This article attempts to make a systematic analysis on the China legal system of agricultural land soil contamination remediation.First,it summarizes the scope of the remediation body,analyzes the problems that the ambiguous relationship among the remediation bodies,the overweight liability of the owner of agricultural land use right and the underweight liability of the government.Further,this article puts forward the reflections of clarifying the final liability,the exemption of the owner of agricultural land use right and strengthening the liability of the administrative body;In the next place,on the problem of remediation process of agricultural land soil,this article discusses the problems that the ambiguous conditions of the agricultural land soil remediation,the weak regulatory on the remediation scheme,the ineffective implement of the information disclosure,incompact regulations of the soil transport,and the qualification of the third-party agency,further it puts forward the recommendations for improvement,for instance,clarifying the remediation premise,perfecting the registration and recording system,strengthening the disclosure of environmental information and elaborating the transport regulation;Finally,on the problem of remediation liability,this dissertation analyzes the deficiencies of the existing legal provisions,finds out the problems that the ambiguous liability of department,single form of accountability,weak administrative accountability and incomprehensive legal liability of the third-party agency.Further,it puts forward the requirements of perfecting the elaborating the liability of each bodies,increase the illegal cost,perfecting the law enforcement measures,and clarifying the legal liability of the third-party agency.
