| The people are the foundation of the country,and food is the foundation of the people.The food issue has always been an important issue,that related to the national economy and the people’s livelihood,as well as the long harmony and stability of society.As a large agricultural country with a long history of agricultural production and a large population,agricultural production and agricultural product quality and safety have always been the red line to the national security and the national survival.Since the founding of the People’s Republic of China,China has spent a lot of human resources,material and financial resources on the modernization of agricultural production and the reform of the agricultural production system.It has basically achieved self-sufficiency in food and has met the simple aspirations of the Chinese people for thousands of years.Since the Chinese economic reform,our country has more improvement of China’s economic strength and technological level,the state has also attached great importance to the quality and safety of agricultural production,and has continued to invest advanced technologies and abundant funds in the agricultural production field,so that China’s agricultural production will increase.However,in recent years,the food quality and safety issues of various agricultural products have been continuously exposed,and news have continued to suffer from various kinds of pollution news on agricultural land,which has caused people to worry about soil pollution in agricultural land.Under the background of times,we need to research and exploration to establish a relatively effective legal system for soil pollution control in agricultural land,and it will be surely play a positive role in the protection of soil quality in agricultural land in China.In addition,China’s "Law on Prevention of Soil Pollution(Draft)" is will be introduced in the near future.This will be greatly promote the development of the rule of law on soil pollution control in agricultural land in China.Since prevention and control of soil pollution in agricultural land is the comprehensive systematic engineering,it is difficult to rely solely on the power of legislation to control pollution.We must coordinate the power in the field of administrative law enforcement and justice.This requires the common development of legislation,lawenforcement,and the judiciary,and take the establishment of multiple linkages between systems to work together.This article aims at the current deficiencies in legislation,law enforcement and justice,proposing some legal advice on the soil pollution control in our country’s agricultural land.In legislation,we need to establish a complete legal regulation and standard system for agricultural land soil.On the judicial system,we should vigorously promote the specialization of environmental justice,and promote the reform of the judicial system of the environment.In the field of administrative law enforcement,we need to rationalize the administrative management system,and strengthen grassroots law enforcement forces,and law enforcement measures.At the same time,the state should establish some protection systems such as the emergency system,subsidy system,fund system,insurance system,monitoring system,etc.By perfecting our country’s legal system,the state will form a systematic legal system for the comprehensive management of agricultural land pollution prevention and control,and ultimately promote the healthy development of agricultural land in China. |
