Study On The Legal Guarantee Of Public Participation In Environmental Impact Assessment Of Marine Engineering

The 21 st century is a century through the ocean.With the development of social economy,the value of the ocean has been paid more and more attention.The use of marine engineering to develop marine resources has become an important strategic measure of marine development in China.Marine engineering is a project built to renovate marine land and develop marine resources.In order to prevent and reduce the marine environmental pollution caused by marine engineering construction projects,China has established a marine engineering environmental impact assessment system.According to the procedures and links of public participation,a number of plans are made,and the corresponding marine system development system is finally formed.However,from the practical effect,there are many problems in the implementation of the public participation system of marine engineering environmental impact assessment,which makes it difficult to fully realize the right of public participation.The purpose of this paper is to sort out the theoretical basis of the public participation system of environmental impact assessment of marine engineering,and to analyze the present situation of the legal system of public participation in environmental impact assessment of marine engineering at home and abroad from the point of view of legislation and practice.Through questionnaire investigation and telephone interview empirical research,this paper identifies public cognition and attitude,and then puts forward some countermeasures to improve the legal guarantee of public participation in marine engineering environmental impact assessment in China.The paper is divided into four chapters:The first chapter introduces the theoretical basis of public participation in the legal protection of Marine engineering environmental impact assessment.This paper mainly analyzes the legal interest value of public participation in Marine engineering environmental impact assessment,introduces the historical evolution of public participation in Marine engineering environmental impact assessment,and defines relevant concepts.The second chapter analyzes the current situation of public participation in the environmental impact assessment of Marine engineering at home and abroad from the aspects of legislation and implementation.This paper reviews the legislation and implementation status of relevant legal systems in the United States,Japan,France,Australia and other countries.This paper introduces relevant contents under the legal framework of public participation in the environmental impact assessment of Marine engineering in China,and investigates and analyzes the contents involved in the system by means of questionnaire and telephone interview.The third chapter analyzes the problems existing in the public participation system of marine engineering environmental impact assessment in China.It mainly includes the narrow scope of the subject and object of public participation,the defects in the definition of public participation stage,the irregular form of public participation,the incomplete disclosure of public participation information,and the imperfect relief system of public participation.The fourth chapter puts forward the countermeasures to improve the legal guarantee of public participation in Marine engineering environmental impact assessment in China.Mainly include strengthening laws and regulations to optimize and improve the work,expanding public participation in the scope of subject and object,build public participation mode,innovation the stage as a whole ocean engineering forms of public participation in environmental impact assessment,improve the system of ocean engineering environmental impact assessment information disclosure and improve the security of ocean engineering public participation in environmental impact assessment remedy system.
