Environmental problems become more serious than ever.As a specialized system that can prevent and mitigate environmental problems,environmental impact assessment system plays an significant role in balancing economic development and environmental sustainable development.As a key part in the environmental impact assessment system,public participation,on the one hand,reflects the democracy of environmental decision,on the other hand,implements the initiative of "everyone is responsible to protect the environment",which has an important role on whether the environmental impact assessment system can be effective or not.In order to maximize the role of the environmental impact assessment system,we must implement the principle of public participation.This paper has four parts.Firstly,elaborating relevant concepts of public participation right,and analyzing the importance of public participation right.Secondly,through the "Green Peacock of Yunnan Province case",several practical problems of public participation right came to light to our face.Then,discussing four legal issues of the public participation right currently that existing in our legal document.Thirdly,making a research on overseas’ public participation right in environmental impact assessment like America,Germany and Japan,and selecting the strong points that can be used for our country.Finally,combine the mature experience of America,Germany,Japan and the actual situation of China,this paper makes four suggestions.First,make information di sclosure system and opinion feedback mechanism better.Second,let the public participation full of the process of environmental impact assessment.Third,let the right of public participation express smoothly.Fourth,improve the environmental public inte rest litigation system.
