A Research On The Prevention And Control Of Rural Environmental Pollution From The Perspective Of Administrative Law

Since the reform and opening up,China's economy has made a series of leaps and bounds,and the rural economy has also made remarkable achievements.However,with the development of economy,the quality of rural environment is deteriorating day by day.On the one hand,rural environmental quality is closely related to the life and health of the broad masses of the people,as well as to the sustainable development of the economy.On the other hand,the mass incidents caused by rural environmental pollution are related to the social stability of our country.How to effectively solve the problem of rural environmental pollution prevention and control is related to the realization of sustainable development strategy,social stability and the health of rural residents.From the perspective of administrative law research,drawing on the successful experience of developed countries in the prevention and control of rural environmental pollution,combining with the current situation and problems of the administrative legal system of rural environment in China,this paper puts forward that the prevention and control of rural environmental pollution in China should be based on three aspects: improving legislation,strengthening law enforcement and perfecting judicial system,at the same time,increasing financial investment and financial support,perfecting legal supervision and perfecting the system of public participation.In order to effectively prevent and control rural environmental pollution and improve rural environmental quality,non-governmental environmental protection organizations should be given their due legal status.The first chapter of this paper introduces the research background,the significance of the research(theoretical and practical significance),and the research summary at home and abroad.Based on this,three research methods are put forward: literature analysis method,case analysis method and comparative research method.Then,the second part of this paper introduces the rural and rural environment,rural environmental pollution,prevention and control of administrative law and related concepts,and introduces the theoretical basis of prevention and control of rural environmental pollution from the theory of administration according to law,environmental justice and sustainable development,and explains the value of prevention and control of rural environmental pollution.Then,the third part of the paper mainly expounds the current situation and problems of the administrative legal system for the prevention and control of rural environmental pollution from three aspects: legislation,law enforcement and justice.This part mainly elaborates on five aspects: imperfect legislative ideas,imperfect laws and regulations,defective law enforcers,imperfect law enforcement agencies and defective judicial organizations.Then in the fourth part,it introduces the legislation,law enforcement and judicial status and characteristics of rural environmental pollution prevention and control in developed countries in detail,in order to provide important reference for the prevention and control of rural environmental pollution in our country.Based on the above problems and analysis,the fifth part of the paper puts forward the reform measures of establishing and perfecting laws and regulations,strengthening law enforcement and perfecting the judiciary on the premise of establishing a scientific legislative concept,with a view to forming a comprehensive rural environmental pollution prevention and control system.The last part of the paper is the conclusion,pointing out that the prevention and control of rural environmental pollution is a long-term complex project,which needs to constantly improve laws and regulations,law enforcement and judicial system,so as to effectively prevent and control rural environmental pollution.
