Research On Legal Issues Of Rural Environmental Administrative System In China

At present, the construction of a new socialist countryside is carrying on vigorously like a prairie fire. One of the thorny problems confronted is how to harmonize the economic building and environmental protection in rural areas.Based on the peculiarity and complexity of the environmental protection in rural areas, the intervention of state power is becoming essential. State power, especially the organizational structure, the functional configuration and the operational mechanism of the state administrative power in the environmental protection in rural areas, must be regulated and institutionalized. Rural environmental administrative system is an important part of the national environmental administrative system. It is a significant manifestation for the intervention of state power to the environmental protection in rural areas. Since little attention has been paid on the rural environmental protection as well as little solicitude been shown on environmental administrative system in the past, the system of environmental administration has limited effect on rural environmental protection and the environmental condition of rural areas continue to turn from bad to worse. Based on the situation of rural environment and the demand of environmental administration, in environmental protection area, the administrative system which only focused on rural areas and some severe pollution-causing industries should be changed step by step. We should gradually strengthen as well as innovatively create a series of administrative system which can best suit environmental protection of countryside. By so doing, the truth that there is insufficient supervision in rural environmental administration can be changed.This article is trying to analyze problems occurred in present rural environmental administrative system from a legal point of view and to give some advices after using some references of related scientific results, so that we can make our humble efforts in the improvement of environmental administrative system in rural areas. There are five sections in this article altogether. In the first section, the introduction section, the author is giving a simple introduction of the researching background, the actual state of the researching background, the actual state of the research related home and abroad and introducing the aims, ideas and methods of researching of the article. In the second section, the outline section, the author is defining"the environmental administrative system"at first, then, giving a completed and detailed introduction to the connotation, development history and the actual situation; at last, combining with the actual situation of rural, the author is presenting an outside factor in reforming environmental administrative system. In the third section, the author is making a comprehensive illustration to the problems existed in the environmental administrative system from three aspects: organization structure, configuration structure of state power, operational system of functions and powers. The author also gives a illustration to the reason of the problems. The fourth section is the key section of the article. In this section, the author illustrates the basic principles to improve the environmental administrative system of rural areas; the, under the guidance of the basic principles, the author gives several legal suggestion to the improvement of the rural environmental administrative system as well as specific solutions. In the fifth section, the author briefly summarizes the result of the research paper.All in all, the improvement of environmental administrative system should be carried on under the framework of the rule of law. Through the reform of some related systems, more scientific, reasonable and effective environmental administrative system in rural areas. Be created to meet the requirements of environmental administration in rural areas.
