Research On Independence Of Environmental Impact Assessment Agency In China

As the only qualified technical service provider entrusted by the construction unit to carry out the environmental impact assessment for the construction project,environmental impact assessment agency should take independent,objective and impartial manner to prepare the environmental impact assessment documents.This is not only the characteristics of the environmental impact assessment agency as an intermediary organization,but also the inevitable choice of the environmental impact assessment system.However,a fact that cannot be ignored is that,group events related to environmental impact assessment occur frequently in practice,some construction projects that have serious adverse effects on the environment can smoothly pass the EIA examination and approval.This reflects that the environmental impact assessment system tends to be virtually meaningless,and it also makes it the focus of public questioning whether the environmental impact assessment agency can maintain independent,objective and impartial attitude in compiling documents.In view of this problem,it is urgent for the states to use scientific environmental governance system to standardize it.In recent years,our country has continuously deepened the reform of the environmental impact assessment system and carried out the policy of "red top intermediary" of environmental impact assessment agency,which has taken a solid step forward in the construction of the independence of the environmental impact assessment agency.At present,our country formulates the policies,laws,regulations and normative documents to manage the environmental impact assessment agency,and requests it to produce the high quality environmental impact assessment document,finally provides the basis for the environmental protection department to make the correct decision.However,due to the pressure of the environmental impact assessment agency to compete with the environmental impact assessment business,the decisive influence ofenvironmental assessment examination and approval department on environmental impact assessment of construction project,the lack of effective public participation of the environmental impact assessment that supervision become a mere formality,which leads to many problems and difficulties in the construction of the independence of environmental impact assessment agency.Facing the problems and difficulties in the independence of environmental impact assessment agency in our country,and on the basis of drawing lessons from the advanced experiences of other countries in the operation of environmental impact assessment systems and the independent work of the agency,we should insist the basic starting point of improving environmental quality and green development.Than from the four dimensions to start with governance as follows: environmental impact assessment agency,environmental impact assessment market,EIA examination and approval departments and public participation system.By innovating the entrust way of the environmental impact assessment agency,regulating the market of the environmental impact assessment,strengthening the responsibility of the environmental impact assessment agency and staff,standardizing the examination and approval behavior of the environmental protection department,perfecting the government accountability mechanism,Widen the channels of public participation,strengthen social supervision and other measures,to ensure the independent construction of environmental impact assessment agency in our country,than makes the environmental impact assessment system to preventing and mitigating environmental pollution from the source,and promotes the sustainable development of society.
