Legal Issues On Rural Ecological Environmental Security In The Process Of Urban-rural Integration

In 2013,the party's report to the 18th National Congress explicitly proposed the construction of an ecological civilization.It emphasized that from the perspective of the"five in one",we must actively promote the process of rural ecological environment governance.In the Party's Nineteenth Congress report in 2017,General Secretary Xi Jinping first proposed the strategy of rural revitalization,depicting a beautiful blueprint for the development of rural areas with "industrial prosperity,ecological livability,rural civilization,effective governance,and affluent life".Ecological livability,as an important part of the overall requirements for rural revitalization strategy,is to speed up infrastructure construction in rural areas and improve rural human settlements.With the rapid development of China's economy and the continuous advancement of urban-rural integration,China's agricultural industry and rural economy have entered a period of good opportunities.However,resources and environment have paid a huge price,and the environmental carrying capacity is approaching the limit.The two problems of environmental pollution and ecological damage are increasingly prominent.On the one hand,the rural ecological environment presents a complex state.Problems such as groundwater pollution,over-exploitation of resources,household garbage,and soil pollution in rural areas make rural environmental issues quite prominent;On the one hand,rural environmental issues are gradually being "homogenized" with urban environmental issues.However,the level of environmental governance and services that rural areas can provide is very different from that of cities,making it difficult for rural ecological environmental issues to be effectively resolved.The legislation,law enforcement,and judicature of the ecological environment protection in rural areas have all obviously lag behind.Legislation lacks specific targets.Law enforcement and justice are all weak in rural areas.Farmers' awareness of environmental protection law is very limited and it is difficult to make full use of existing laws.The environmental protection rights that the route protection continuously suffers from will seriously affect the process of urban-rural integration,and it will also be detrimental to the implementation of the rural rejuvenation strategy.In the actual context,this article uses the methods of context analysis,comparative analysis,case analysis and other methods to study,collate and summarize the literature,and elaborate the related theories of sustainable development,interest balance,etc.From the current rural ecological environment Starting from the problems,analyzing their causes,based on the experience of the typical national environmental governance outside the domain,the relevant legislative proposals and safeguard measures are put forward,and suggestions are provided for advancing rural ecological environmental safety protection in China and constructing a modern,ecological,civilized and healthy rural society.The content of this article is divided into seven major parts.The first part is the introduction of the article.To introduce the background,research purpose and significance of rural ecological environment security in the process of urban-rural integration,literature review,writing ideas,research methods,research innovation and inadequacies.The second part is the theoretical basis of economic law for the definition of related concepts and protection of ecological environment.The concept of "ecological and environmental security" was defined in turn,and the balance of interests theory,market regulation theory,and sustainable development theory were elaborated in detail.The third part is the actual investigation of rural ecological environmental.problems in China and empirical analysis of cases.We will focus on the specific performance of the ecological environment in rural areas,identify existing problems from the status quo,and combine case empirical analysis to comprehensively consider the underlying causes of these problems.The fourth part is the experience of foreign rural ecological environment protection.By summarizing the experience of protecting rural ecological environment safety in advanced agricultural countries such as the United States,Britain,and Japan,we pointed out the enlightenment significance for the protection of rural ecological environment in China.The fifth part is the improvement of China's rural ecological and environmental security legal system.It mainly includes the basic principles of China's rural eco-environmental safety legal system and the specific system of rural ecological and environmental security in China.The sixth part is the guarantee mechanism for the operation of the legal system of rural ecological environment in our country.The protection of rural ecological environment should establish a good operational guarantee mechanism from the aspects of specific legislation,law enforcement,law enforcement and justice,and legal supervision mechanisms.Raise rural villagers' awareness of the eco-environmental laws,strengthen the popularization of law and environmental protection,improve the interest mechanism of farmers' public participation in ecological environmental protection,and finally vigorously
