China is a large wetland country.Although the legislation of wetland started late,the legislation of wetland protection,especially the local legislation,has developed rapidly in recent years.Wetland ecological compensation is the balance of the contradiction between the wetland protection and development and utilization of the most effective means of the wetland ecological compensation legislation for regulating the wetland ecological compensation is of great significance,but in our country from the central to local hasn't been introduced a special wetland ecological compensation legislation and regulations related to wetland ecological compensation are referring to individual provisions in other laws and regulations,and so very general,weak operational.Hunan province is a big province of wetlands,wetland resource is very rich and ecological service value is extremely high,to our country and even the world's ecological environment has significant influence,wetland protection status in Hunan province have also been widespread attention at home and abroad.Although Hunan province has formulated many protective regulations on wetlands,which have played a certain role in protecting wetlands,it has not really improved the ecological environment of wetlands.A large number of practical experience shows that it is very important to improve the ecological compensation system of wetlands to solve the contradiction between wetland protection and economic development,and to effectively protect wetlands.Therefore,it is an important measure to make special local wetland ecological compensation legislation and coordinate the relationship between wetland protection and exploitation and utilization.The concept of wetland ecological restitution in the article is the definition of the legal meaning,which is that the state,society,the relevant organizations and the ecological resources of the wetland ecological resources,the beneficiaries of the sustainable development of the wetland ecological resources in order to give up the economic benefits of some of the interests of the development of the development of the wetland and the protective investment of the key wetland ecological reserve.This definition clearly shows that the legislation of wetland ecological compensation is to solve the contradiction between wetland protection and exploitation and utilization.Through the analysis of the national and provincial legislation on ecological compensation of local wetlands and the current provisions on ecological compensation of wetlands in Hunan province,it is concluded that it is necessary and feasible to legislate ecological compensation of wetlands in Hunan province.However,there are still some practical and theoretical obstacles in the legislation of wetland ecological compensation in Hunan province,such as the lack of wetland ecological compensation methods,the lack of scientific basis for wetland ecological compensation standards,the single liability of wetland ecological compensation,the single source of wetland ecological compensation costs,and the lack of provisions on compensation and relief procedures.Therefore,according to these legislative hurdles,should further enrich the wetland ecological compensation way,to establish a rational standard of the wetland ecological compensation,achieve the wetland ecological compensation liability subject diversification,actively expand to absorb the social capital investment channels,detailed set of ecological compensation is the wetland ecological compensation relief program,work for a special wetland ecological compensation legislation,effectively coordinate the relationship between wetland protection and utilization,and actually improve the ecological environment of the wetland in Hunan province.
