Study On The Legal System Of Regional Mineral Water Resources Development And Protection

Mineral water resources,a precious type of resources beneficiaI for human body,is of significance for promoting human health,driving regional economic development,and maintaining ecological balance.With the development of Chinese mineral water industry and expansion of the market,conflicts on the exploitation and protection of mineral water have been intensified as well.As a result,the exploitation and protection of mineral waters have been noticed around China,and work has been done in legislation to regulate relevant work to protect and utilize mineral water in a more scientif ic and reasonable manner,and good results have been met with.However,in view of some special attributes of mineral water resources,numerous problems have also been met with during the legislation process in different places,such as of the application of higher-level law,over lapped rights of administration and supervision departments,imperfect specific rules,etc.,which should be settled urgently.Therefore,this paper,with an aim of tapping and protecting mineral waters in various regions,starts with research and assessment of relevant legislation.Then,using the methods of literature research,normative analysis,diagnoses,comparative analysis,etc.it makes a deep analysis of the laws and regulations on mineral water resources exploitation and protection.Based on it,for the common problems existing in the legislation,some suggestions are proposed,so as to provide some reference for future legislation on mineral water resources exploitation and protectionThis paper will be divided into four partsThe first part makes a general introduction to mineral water resources,from the perspectives of its concept,characteristics,and classification,and then it makes an analysis and categorization of mineral water resources,which will be the basis of the whole paperThe second part introduces the common legal issues in the exploitation and protection of mineral water resources,mainly in the two aspects of exploitation and protectionThe third part makes an evaluation and analysis of the legislative principles and specific rules on regional mineral water resources exploitation and protection.It is based on the concrete measures taken according to the laws,in terms of their advantages and disadvantages,and then it focuses on whether the legal issues in the first part have been solvedThe fourth part makes suggestions for improving regional mineral water resources exploitation and protection.After research on the laws and regulations on mineral water resources exploitation and protection,the author will propose corresponding improvement measures.
