Research On The Legal System Of Ecological Compensation For Mineral Resources Exploitation Of Our Country

Because of the old concepts and the pursuit of interests,the mineral resources are in the process of continuous depletion,and the environmental destruction followed.The recovery of the ecological environment in the mining have become a serious problem,ecological compensation legal system for mineral resources development came into being.We conducted a series of studies on ecological compensation for mineral resources exploration,under the call of our country,localities have also developed corresponding policies and achieved initial success;but the lack of the systematic legal system,uniform standards and the relevant legal system,it is hard to smoothly carry out the ecological compensation work across the country.The theory and practice of ecological compensation abroad much more advanced than the domestic,drawing on foreign experience is an important perspective to improve our system.Starting with the legal connotation of ecological compensation for mineral resources,then I analyze the status quo of it,concluding the problems in the legal system,finally,learn from foreign country's advanced theory and practice,I'll put forward a sound ideas of ecological compensation legal system.Aiming at the obstacle to improvement of the legal system,specific approach as followed: In the respect of legislation,first,we must establish the principle to command the ecological compensation;second,what we need do is to establish a comprehensive legislative system,to clear the subject,standards and so on;furthermore,we should reform the existing tax system of mineral resources;and finally broadening the sources of funds is necessary.As the law enforcement,we should ascertain the executive and their responsibilities in the whole process of law enforcement,to build the coordination mechanism of law enforcement and strict implementation of law enforcement responsibilities ensuring the realization of the ecological compensation in the mine area.As the supervision,establish a special internal regulatory mechanism of ecological compensation,to take measures made the inspectorate institution succeed in supervisory functions;improve the rights of public participation procedures,ways and so on,make sure the realization of the legal system of ecological compensation in the mine area.
