| Agricultural land resources are an important basis for farmers’ survival and development.Along with the accelerating process of urbanization in China,the scale of land occupation continues to increase,and the speed of land transfer to farmers is increasing,and more and more farmers are also Loss of the material basis for survival and development.Although the acquisition of agricultural land is necessary for the urbanization of a country,due to the endogenous defects of the current land acquisition system in our country,and the low compensation and resettlement standards in the compensation and resettlement system,the compensation and resettlement method is too single,and the compensation and resettlement scope is too narrow.Problems such as the irrational compensation and resettlement procedures,and the legal rights and interests of the land-requisitioned people are often difficult to guarantee in the compensation process for land acquisition.Moreover,once the land is expropriated,farmers often lose more than just basic production and living materials for their livelihoods.Under circumstances where the social security system is not sound,the landless peasants’ re-employment,medical treatment,old-age care,and children’s schooling will be many aspects.Can not guarantee.This will inevitably aggravate the conflicts between landless peasants and the government,and it will certainly have a serious impact on the harmonious and stable development of our country’s society.Therefore,it is necessary and necessary to establish and improve a scientific and reasonable compensation and resettlement system for land acquisition.This paper mainly selects compensation and resettlement for land acquisition as the research object.Based on the empirical investigation of S village in F County,this paper comprehensively analyzes the problems of compensation and resettlement in land acquisition and puts forward corresponding countermeasures.The article mainly includes the following contents: First,an overview of the basic issues of expropriation,compensation and resettlement,related concepts of land acquisition,compensation and resettlement,theoretical basis for land acquisition,compensation and resettlement,domestic and foreign research status,and changes in China’s compensation and resettlement system for land acquisition;Secondly,taking S village in F County as the sampling point,using empirical research methods,the investigation and analysis of the status of compensation and resettlement for rural land acquisition in S County,F County were conducted.Combined with relevant theoretical knowledge and empirical data,qualitative and quantitative analysis methods were used to explicitly provide compensation.In the resettlement,there are problems such as low compensation and resettlement standards,narrow compensation and resettlementscope,imperfect compensation and resettlement procedures,and inadequate social security.On this basis,the specific reasons for these problems are clarified.Finally,on the basis of the theory of land property rights,land rent theory,the theory of fair burden,and social security theory,on the basis of fully drawing on the experiences of other countries in advanced compensation and resettlement,we will improve the compensation and resettlement system for the acquisition of agricultural land in China,and maintain the relationship between the government and the land-requisitioned.Balance the interests,protect the peasants’ real rights and interests in the land acquisition and compensation and resettlement,and promote the smooth progress of land acquisition. |
